Trillanes vs GMA

11/29/07

Posted under Philippine politics, Rule of law

Antonio Trillanes, failed mutineer turned Senator of the Republic, has decided to play for all the marbles. After holing up in the Manila Peninsula with about 30 soldiers, he has  asked the public to choose between him and the President.

I get the sense that this pseudo-mutiny or quasi-coup will not end peacefully.

“Jossher you can continue playing the idealism card.”

You are the first person I have heard in my entire life that says idealism is or morals for that matter are bad.

“Jossher but if you use a little more common sense you will realize that Trillanes and Lim were ESCAPED FUGITIVES.”

Fugitive? The term “fugitive” as in fuigitive from justice means “a person convicted a crime who hides from the law.” Apparently, in your world Trillanes is already guilty before a court of competent jurisdiction declares him to be such. Apparently, you also missed the class on a person’s right to be “presumed innocent” until proven otherwise.

“they were committing a crime in inflagrante delicto.” Which crime was that? You say sedition? Art. 139, RPC will tell you different. Know the legal elements of the law first before you accuse people of crimes.

“possession of firearms”…was Triallanes in possession of a firearm? There is no such crime as possession of a firearm by osmosis.

“trespassing”? Art. 280 and 281, the only law on trespass requires that it be a dwelling. Is the lobby of the Manila Pen a dwelling? The other kind of trespass requires that it be a “closed premises or the fenced estate of another.” As far as I know, the Manila pen was open at that time.

“As for the media arrests it strikes me that they were subject to due process of law, any searches and seizures considering the cirumstances were reasonable, and they were right smack dab in the middle of a crime scene.

Due process means the right to be heard (in court) before one is arrested or incarcerated. Which constitutional standard of reasonableness are you referring to? I’m not even sure if they still do that in the former communist block.

I still have to read a case penned by the Philippine or U.S. Supreme Court which espouses such a standard.

“But please consider first who you would consider a good president.”

How about Ramon Magsaysay? Manuel Quezon, Sergio Osmena and Manuel Roxas. Fidel Ramos, even with the corruption, was a way better President than GMA. At least Ming Ramos had the decency to stay away from government projects.

“Jossher as long as you and people like you keep sticking your heads in the sand as to the root causes of the problem by simply blaming politicians for their lack of morality, expect this country to continue going nowhere.”

So you think congratulating them for stealing the electoral process and government money is the answer? It is not only our right to blame them but it is our duty to tell them if they are VIOLATING THE LAW. No one, including “your beloved politicians,” are above the law.

How about you? What have you done to help the country? Play the stock market? You are not even investing long term enough to help the capital market in the Philippines which up to now is one of the smallest stock exchanges in the world. You think the Philippine stock exchange is full of honest people? I know politicians and corrupt businessmen from the time of Marcos up to now who play up the prices and hurt legitimate investors.

From your statement: “I was making money yesterday riding my stock positions higher on a global rebound in the financial markets but then that irritating idiot Trillanes crawled out from the hole he was banished to and lost me some dough. Why do people support such morons?” It appears that you only think about yourself and your profits. Clearly a SELFISH individual who does not care about his country and his fellowmen. Now I understand why you seem not to like the “morality” and “idealism” arguments.

“For those uneducated people out there without capital I feel sympathy. I presume, however, those of you reading this with your internet connections are educated and for you there is no excuse.”

You also seem to have some sort of “superiority complex” bordering on narcisistic tendencies. Looking down at people by reason of their low educational level or financial inability, just shows the kind of values you were taught. It’s sad.

ok lang ba na sila ang maglamang kapwa, you should also condemn what they did to that poor security, the way they force themselves into the hotel……

bakit kailangan pang bumaba si trillanes at mag fashion show para lang palabasin ang mga hotel guest, what is their original intention, innocent warm bodies to shield them, di ba………….

ay, public statement or press conference pala, akala ko magkakape lang, sorry……

do you honestly believe on what you are saying………

gma cannot declare martial law like marcos did, there are now checks and balances before she can do it…………

yan ang pinoy, inaapi na nakatawa pa. antay antay lang tayo, hindi si trillanes ang savior ng pinas, don’t choose between two evils………

may lalabas at lalabas ding taong karapat dapat na mamuno sa atin……….

lets us all pray for the betterment of our people and country………

    Eureka
Sorry for the third consecutive post but I was catching up on all that was said previously.

“Apparently, you were absent when they taught the Constitution in Social Studies and Philippine History at your school:

“Sec. 1. No person shall be deprived of life, liberty, or property without due process of law…”; “Sec. 2. The right of the people to be secure in their persons, …against unreasonable searches and seizures of whatever nature and for any purpose shall be inviolable, and no…warrant of arrest shall issue except upon probable cause to be determined personally by the judge…”

“Sec. 4. No law shall be passed abridging the freedom of speech, of expression, or of the press, or the right of the people peaceably to assemble and petition the government for redress of grievances.”

Why thank you for the civics and constitutional law lesson Jossher but if you use a little more common sense you will realize that Trillanes and Lim were ESCAPED FUGITIVES. They do not need to be served arrest warrants. Furthermore they were committing a crime in inflagrante delicto. Sedition comes to mind but if you want nitty gritty escaping from arrest, possession of firearms, trespassing, and creating a public disturbance can easily be thrown in, maybe even economic sabotage. Are you seriously going to question the illegality of Trillanes and Company’s actions???

As for the media arrests it strikes me that they were subject to due process of law, any searches and seizures considering the cirumstances were reasonable, and they were right smack dab in the middle of a crime scene. Media who were outside were not detained. Moreover, they were released pretty quickly and are free to protest their detention.

    I don’t see the problem.

    ***************
You didn’t see a problem because you don’t want to see it. Just like Gloria Arroyo, She keep saying to follow the rules of law; But, Yet she’s the one shitting the rules of law; Sa dami ng kasalanan niya sa tao bayan only rules of force can set her free. She’s the one should be in jail for all the corruption she has been doing. But, That will never happen because she control the entire corrupt justice system.

Ahh finally the blogsite is being filtered. The discussion was degrading into a flame war and the recently lack of editing prodded me to fight fire with fire. Apologies to John and Manuel for the tit for tat I had to respond to less civilized individuals in this blog.

In any case, it doesn’t matter. If this government does not change it ways and eradicate corruption, Gloria administration has a great danger of falling just like the Erap administration. Expect more natural and man-made calamities to come in the future if corruption is not addressed.

Other major concerns are the destruction of our environment. pollution, and general state of consciousness of the populace still treating money as god and also exploiting and abusing his fellowman and nature.

Take heed this warning, what has to happen will happen unless these evil ways are changed.
