These idiots is not ashame of themselves for what they’re doing. The reason the did the survey to make sure that the military is not going to do the coup d’tat Against the bugos President of cebu. What make them think the military who voted for capt. Trillanes, Going to give them what they want. Anong palagay nila sa amin tanga!!! Goodluck!!!

Its a good thing they didn’t contenue their cheating operation against Capt. Trillanes, Otherwise somebody will pick them up in the cabbage patch field. And they knows it too.

Military chief unhappy with Trillanes’ poll victory (9:44 a.m.)

MANILA — Armed Forces Chief Hermogenes Esperon Jr. said personally the election victory of Magdalo group leader Navy Lieutenant Senior Grade Antonio Trillanes IV is not “the most welcome thing for me.”

Esperon did not elaborate except to say that Trillanes would have a problem because under the rules of the military court, no soldier facing a serious offense is allowed to post bail or be release from jail.

Trillanes is due to be proclaimed on Friday morning as senator by the Commission on Elections (Comelec), sitting as the National Board of Canvassers (NBOC), achieving a first in the country’s political history because he will be declared a senator despite being detained.

Trillanes, one of the core leaders of the short-lived Oakwood mutiny in July 2003, is held in Fort Bonifacio for a charge of coup d’etat pending at the Makati City court.

Trillanes is also facing a violation of the Article of War 96 or conduct unbecoming of an officer and a gentleman before the military’s general court martial. He may be dishonorably discharged from the service if found guilty of the charge.

While Esperon was unhappy with Trillanes’ win, National Capital Region Command (NCRcom) chief Ben Mohammad Dolorfino welcomed the proclamation of Trillanes.

Dolorfino said it is nice to see another military officer and a graduate of the
Philippine Military Academy (PMA) securing a seat in the Senate.

Trillanes is the fourth former police or military man in the Senate. The three others are Panfilo Lacson and Gregorio Honasan, both of the PMA Class 1971, and Rodolfo Biazon of the PMA Class 1961. Lacson and Biazon served as PNP chief and AFP chief, respectively.

On the pronouncement of Trillanes that he would be fighting for the welfare of the military when he is already in the Senate, Dolorfino said: ”Maybe it has
to be if he will indeed look into the welfare and interest of the men in uniform.” (VR/JMR)M

AFP CHIEF Gen. Hermogenes Esperon Jr. said yesterday that the senatorial victory of Antonio Trillanes IV is not “the most welcome thing for me.”

“Once he gets proclaimed, I will start talking about his case. Ganun lang para fair. For that matter, it is not really Trillanes that I will be talking about, (but) the rules on general court martial, how it applies to anybody who has a case before the court martial, and for that matter in the regional trial court for a non-bailable offense,” he said.

Aside from the coup charges before a Makati court in connection with the botched 2003 Oakwood mutiny, Trillanes also faces court martial proceedings for conduct unbecoming an officer and a gentleman.

Esperon said the Articles of War, for which Trillanes had been charged before the military court for violating several provisions, could not easily be disregarded as it would mean a disregard for military discipline as well.

He added that it could also lead to the wrong notion that those facing court martial or other criminal cases may escape the charges by winning an elective position.

“Just imagine if barangay elections will come and all soldiers who have cases will file for candidacy so they can get off the hook. Is that it? Hindi naman. Again I repeat, I do not want anything to do with the election of Trillanes whether he wins or lose. The AFP has nothing to do with that, but we have our concerns insofar as upholding the Articles of War,” he said.

Esperon said that with Trillanes as a senator, he does not foresee any problems for the military.

He also laughed off questions if he would address the Magdalo core leader “Your Honor” in case Trillanes summons the AFP leadership in Senate inquiries.

He said they accept the fact that Trillanes, as a senator, may have a hand in drawing up the budget of the military, including possibly blocking it.

“That’s the job of a senator. That’s perfectly all right with us. But why should we look at him as a problem? Siya ang may problema. Siya ang may kaso,” he said.

He just expressed hope that Trillanes would be part of the “mainstream” and become less of a headache for the government.

AFP National Capital Region Command chief Maj. Gen. Ben Mohammad Dolorfino said with the victory of Trillanes, the military is placed in an “uncomfortable situation.”

“The situation is uncomfortable because he is being held accountable for the rules and regulations of the Armed Forces and our justice system. It’s like an unusual situation - somebody who is charged of coup d’état is becoming a senator,” he said.

Nevertheless, Dolorfino said its “nice” to see another PMAer and a former military officer winning in the elections “although he has yet to clear his name from the criminal charges related to the Oakwood mutiny.”

Trillanes belongs to Philippine Military Academy Class 1995.

On Trillanes’ pronouncement that he would be fighting for the welfare of the military, Dolorfino said: “Maybe it has to be if he will indeed look into the welfare and interest of the men in uniform.”

Dolorfino said he is not aware how military officers are taking the victory of Trillanes although he said he does not see any security threat about Trillanes’ proclamation as a winner.

Dolorfino said joining politics is a better option for officers instead of mounting coups.

Executive Secretary Eduardo Ermita said he hopes Trillanes IV will do a good job.

Asked if he expects Trillanes to become an asset in the Senate, Ermita said the more important issue is the legal implications of his election and how it would affect his role as a senator. – With Victor Reyes

This is another dubious move by the powers-that-be-without-any-mandate.

The soldiers taking the survey questionnaires have no choice but to take the pro-GMA and anti-Trillanes side lest they suffer the fate of those who have openly dared to go against the evil designs of this administration.

The AFP will then brag that the results of the survey show that members of the AFP did not support Trillanes in the last elections.

This administration is really very good at twisting the truth by hook or by crook!

It is a very clear message that Gen. Esperon can not believe Senator Trillanes won the election. Else, he should not conduct a survey among the soldiers. Gen. Esperon should be held liable for his action in the AFP, which is against the Philippine Constitution…

That was the reply of a smiling Antonio Trillanes IV when pressed by reporters during an impromptu press conference at the Commission on Elections about his message to Malacañang now he is proclaimed as senator-elect.

Trillanes, a soldier-turned-politician linked to a failed mutiny, was proclaimed Friday morning as the 11th winning senatorial candidate of the May 14 elections.

Trillanes attended the proclamation on the eighth floor of the Comelec office in Manila at 11:34 a.m. wearing a collarless barong. He smiled as Comelec Chair Benjamin Abalos raised his hand in victory minutes later.

“The Commission on Elections sitting en banc as the National Board of Canvassers hereby proclaims Antonio F. Trillanes IV as one of the duly elected senators of the Republic … to serve for a term of six years beginning on June 30, 2007,” Abalos said.

Interviewed by reporters, Trillanes said he “cannot claim credit for this [poll win].”

“It is solely the people’s victory. Wala akong gagawin kundi suklian ito ng serbisyo publiko (I will return the favor with public service),” Trillanes said.

He arrived at Comelec office in Intramuros, Manila in handcuffs escorted by a six-vehicle convoy from his detention at the Philippine Marine Corps headquarters in Fort Bonifacio, Taguig City.

In officially announcing Trillanes’ victory, Abalos said the remaining uncanvassed votes “will not materially affect” the 11th place standing of the former Navy officer.

Trillanes gained the Senate seat with 11,138,067 votes, excluding votes from the controversial Maguindanao polls.

He now leads fellow opposition bet Aquilino “Koko” Pimentel III by 272,666 votes and the administration’s Juan Miguel Zubiri by 384,227 votes.

The Comelec only needs to tally votes from Maguindanao province, which has more than 300,000 registered voters, and several thousand votes from a few towns in Basilan.

Senator Rodolfo Biazon, a fellow alumnus of the Philippine Military Academy (PMA), was present during the proceedings. Biazon is a member of the PMA Class ’61 while Trillanes is a member of Class ’95.

Trillanes is the fourth PMA graduate to comprise the current Senate. Aside from Biazon and Trillanes, other PMA alumni are classmates Panfilo Lacson and Gregorio Honasan of Class ’71.

Noted mother and son filmmakers Armida and Carlitos Siguion Reyna, both active critics of the Arroyo administration, were also present.

Some attendees wore armbands with the insignia of the Magdalo, the mutinous group which launched the failed takeover of the Oakwood Premier Suites in Makati City on July 27, 2003.

The senator faces coup d’ etat charges before the Makati regional trial court-Branch 148 and is also undergoing court martial proceedings over the uprising.

The court granted Trillanes’ request to attend the proclamation, but Armed Forces chief Gen. Hermogenes Esperon Jr on Friday morning did not readily allow the former Navy officer to leave detention.

In a radio interview earlier in the day, Esperon said Trillanes’ lawyer Rey Robles would have to inform the Armed Forces in writing that his client was seeking the transfer.

He said these were “rules of confinement” which have to be adhered to, similar to what he said were security measures at airports.

“We are not trying to obstruct anything, even the performance of senator-elect Trillanes, but there are procedures [we have to follow],” Esperon said.

The military chief added that, “This must not be interpreted as an obstruction.”

However, Trillanes threatened to file contempt charges against Esperon minutes earlier for allegedly refusing to recognize the authority of the judiciary.

“We are giving him (Esperon) the chance to redeem his position, he’s digging his own grave,” Trillanes said in a separate radio interview.

Ilang araw bago iproklama si Sen. Antonio Trillanes IV, panay ang buga sa media ng Armed Forces of the Philippines (AFP). Nariyang aminin nila na naglunsad sila ng survey sa hanay ng mga sundalo para maliwanagan daw sila kung bakit sinuportahan ang kandidatura ng detenidong mutineer. Ibig sabihin, alam na ng pamunuan ng AFP na talagang maraming sundalo at pamilya ng mga ito ang bumoto kay Trillanes.

Bakit kailangan pa nilang i-survey ito? Ano ba ang kailangan nilang malinawan pa? Hindi ba obvious na bilib ang mga sundalo sa paninindigan ni Trillanes? Na sang-ayon din ang mga bumoto sa kanyang ipinaglalaban? Bakit ang mga sibilyang bumoto ay hindi naman iniisa-isa at tinatanong o pinagpapaliwanag kung bakit binoto nila ang isang kandidato?

Kasi bawal ‘yan! Kaakibat ng ‘right to suffrage’ o pagboto ang ‘right to privacy’ kaya hindi kailangang depensahan ng sinuman ang pagpili niya sa kandidatong ibinoto.

E, bakit nga ba merong ganitong survey sa AFP? Hindi kaya ang gusto lang nilang malaman ay kung bakit sumuway ang mga sundalo sa ‘pailalim’ na order na huwag iboto si Trillanes? Ito kasi ang umiikot na usap-usapan bagama’t ilang beses na rin itong itinanggi ng AFP.

Tapos ay paulit-ulit din sa pagsasabi ang AFP na hindi sila nababahala sa pag-upo ni Trillanes sa Senado. Sa katunayan daw ay natutuwa sila na mayroon na silang kinatawan sa Senado na magsusulong ng interes ng mga sundalo. Kung mayroon daw mamomroblema kung sakali ay si Trillanes mismo dahil mananatili siyang nakakulong para harapin ang kasong nag-ugat sa Oakwood mutiny.

Hindi pala problema si Trillanes, bakit kailangang may ‘last minute’ na pagharang kahapon sa proklamasyon nito? Bakit ngayon ay sinasabi ng sandatahang lakas na kailangan ang permiso ni AFP chief of staff Gen. Hermogenes Ebdane tuwing pupunta sa Senado si Sen. Trillanes para tumupad sa kanyang tungkulin at sa mandatung ibinigay sa kanya ng sambayanan?

Bakit kay Esperon? Hindi ba dapat ay sa Makati City Regional Trial Court (RTC) kung saan siya may kasong rebelyon at sa General Court Martial kung saan siya may kinakaharap ding mga paglabag sa Article of War?

Ano nga ba ang ikinatataranta nila kay Trillanes? Baka hindi lang nila makayanang i-address si Sen. Trillanes na “Your Honor” sa mga susunod na araw na kailangan nilang humarap sa Senado sa anumang kadahilanan.

I am shocked to find out that LT Trillanes got elected in the Philippine Senate.

I have relative in the Philippine military who wants to be a politician someday. I think I will urge him to stage a mutiny too to get media attention. I am sure he will be elected like LT Trillanes.

One would say, that’s ridiculous. Well, Sen Honasan did it then. A few years ago, LT Trillianes staged a mutiny, ran for office and won. I will not be surprized if another adventurous military junior officer will do it in the next few years.

I am not sure the average Filipino understand how much damage LT Trillanes & Co’s mutiny did to the Philippine economy. The mutiny cost the philippines several billions of pesos as many foreign investors decided to invest millions of dollars in more stable countries in Asia.

It is true corruption is rampant and has always been a problem in the Philippines.
LT Trillanes then claimed that he and his group approached Pres. Arroyo about their concern of corruption in the military.
But Pres. Arroyo ignored them. So, they staged a mutiny.
My question is why did he not approach Senators Lacson and Honasan who were ex. military. This led me to question his motives in staging the mutiny. I believe he did it as a media stunt to get media milleage– a prerequisite to get elected in the Philippines.

If you think about it, the Philippines had several lawmakers who are ex military, and currently we have two ex military senators(Lacson & Honasan) who already had several years as law makers on their belt. If they are really concerned about the military, then how come they did not do anything to curb corruption in the military?

Anyway, I do hope Senator Trillanes will be different this time. I hope he will really make a difference in the military by curbing/ending corruption. In addition, I do hope he will help in the effort to minimize corruption among public servants in the Philippines.

If he accomplish these tasks, then we can probably say that the end justifies the means.

Yes, the majority might have miscalculated, to the dismay of some, the popularity of now Sen.Trillianes in the hearts and minds of the people.No one had ever thought in their own imagination that this guy would be popular among the masses whether or not votes against the present regime.

Or perhaps you and me would like to likened some filipinos——-of being a fanatic action movie admirers knowing that he was a rebel soldier. His fellow mutineers at the Oakwood apologized but he never did. Instead he decisively expressed and strongly stood for his thoughts and opinions in his own right. For this, people must have seen and felt he can act as a representative for the sentiments of many. Am not an admirer but I share this as an opinion.

Pinipilit kong intindihin si AFP Chief Hermogenes Esperon sa kanyang pikon na pananaw sa pagkapanalo ni Lt(sg) Antonio Trillanes IV sa pagka-senador.

Napanood ko sa TV noong Biyernes ng gabi ang reaksyon niya sa pinakahihintay ng bayan na proklamasyon ni Trillanes bilang senador. Hindi maitago ni Esperon ang kanyang inis.

Sa halip na makinig sa boses ng 11 milyong Pilipino na bumoto kay Trillanes, ang mga balakid pa rin ang kanyang pinagsasabi ni Esperon. Porke’t sinasabi raw ng Articles of War ito at ito.

Ngunit ito ang sinabi ni Esperon na nagpapahiwatig ng nasa-panic mode sila sa military: “Sige gusto gumalaw, subukan nila.”

Natatakot ba si Esperon na magkaroon ng coup o paggalaw ang mga military? Bakit ganoon siya magsalita? Halatang insecure.

Dahil kaya sa damang-dama niya ang sampal sa kanya ng mga kasundaluhan na nagpanalo kay Trillanes kahit na nag-order siyang bomoto sa mga kandidato ng Team Unity ni Gloria Arroyo. Kahit na pinag-utos niya, sa pamamagitan ng kayang Army chief na si Gen. Romeo Tolentino na alisin ang mga posters ni Trillanes sa paligid ng military camps.

O baka naman nakita niya sa mga sagot ng mga batang opisyal sa survey na kanilang isinasagawa na walang respeto sa kanila ang karamihan sa mga batang opisyal.

Dapat lang talagang mag-alala si Esperon sa kalagayan niya ngayon sa nagising na sandatahang Pilipino.

Sabi nga ni Trillanes, armed forces o ang sandatahang hukbo ng Pilipinas ngayon ay kaanib na ng sambayanang Pilipino. Pinakita ng mga sundalo, sa pamamagitan ng pagboto sa kanya, kasama na ng kanyang mga pamilya, na dama nila ang damdamin at hinagpis ng sambayanang Pilipino.

Pinakita ng ating mga sundalo na panig sila sa katotohanan at sa hustisya. Ayaw nila ng dayaan, kurakutan at walang pankundangan pagpatay sa kapwa Pilipino.

Dapat lang talaga mag-alala si Esperon, ang isang ehemplo kung paano umakyat sa liderato ng AFP sa pamagitan ng pagsisipsip sa may kapangyarihan, kasama na ang pagbabastos sa sandatahang hukbo.

Ang hilig-hilig ni Esperon magbanggit ng batas at Articles of War. Mabuti nman. Ngunit hindi niya dapat piliin lang ang gusto niyang parte ng batas. Dapat intindihin niya ng mabuti ang buod.

Sinabi ng Constitution ang Armed Forces ay hindi naki-alam sa pulitika. Bakit niya tinulungan si Gloria Arroyo mandaya noong 2004 elections. Sinabi sa Constitution na ang Armed Forces ay tagapagtanggol ng sambayang Pilipino.

Pagkatapos mabuko ang pandaraya ni Gloria Arroyo noong 2004 election, lumabas sa survey na pito sa sampung Pilipino ay ayaw kay Arroyo. Bakit siya patuloy na nagtatanggol kay Gloria Arroyo?

Pinayuhan kahapon ng Malacañang ang kapoproklama pa lamang na senador na si Antonio Trillanes IV na tumalima hindi lamang sa mga kautusan ng korte, kundi maging sa mga panuntunang ilalatag ng Armed Forces of the Philippines (AFP) at ni Chief of Staff Gen. Hermogenes Esperon.

Sa panayam kay Executive Secretary Eduardo Ermita, sinabi nitong kung anuman ang mga ipatutupad na kautusan ni Esperon kaugnay sa magiging set-up ni Trillanes sa pagpasok sa Senado ay kailangan ding mabigyan ng bigat.

Iginiit ni Ermita na bagama’t may hurisdiksyon ang sibilyan na korte kay Trillanes dahil sa kasong rebelyon na isinampa laban dito, hindi naman maaaring balewalain ang kasong paglabag sa Articles of War na kinakaharap ng Magdalo leader sa General Court Martial.

Matatandaang bahagyang nabitin ang proklamasyon kay Trillanes kamakalawa matapos igiit ni Esperon na kailangang humingi rin ito ng pahintulot sa Court Martial kahit pa pinahintulutan na ng Makati Regional Trial Court na makadalo ito sa proklamasyon.

Ikinatuwiran ni Esperon na maituturing din na may hurisdiksyon sila kay Trillanes dahil sa kaso nito na nililitis sa Court Martial.

“If that’s what the Chief of Staff said then that’s the way it should be,” pagsang-ayon naman ni Ermita.

Maliban dito, tumanggi na ang Kalihim na magbigay pa ng mas malalim na paliwanag sa isyu kay Trillanes dahil sangkot na rito ang mga legal na usapin, lalo pa’t ito ang kauna-unahang pagkakataon na ang isang sundalong nakakulong ay nahalal na senador.

“That’s a political issue. I can’t really comment on such legal matters. Tingnan na lang natin ang mangyayari,” dagdag ni Ermita.

Samantala, nagdiwang sa buong bansa ang mga supporters ni Trillanes matapos itong maiproklama ng Commission on Elections (Comelec) bilang ika-11 nanalong senador.

Para naman sa mga supporters ni Trillanes na nasa iba’t ibang panig ng bansa at hindi makaluwas ng Maynila, sa kanilang probinsiya na lang umano nagdiwang ang mga ito sa pagkakapanalo ng Magdalo leader.

“Ang daming nag-text sa mga supporters ni Trillanes, nagse-celebrate din daw sila doon sa pagkakapanalo ng kanilang kandidato,” paglalahad pa ni Rivera.

Sinabi pa ni Rivera na pinag-iisipan na ngayon ni Trillanes kung paano makababayad ng utang na loob sa mga taong sumuporta sa kanya sa nakaraang halalan.

Pinayuhan kahapon ng Malacañang ang kapoproklama pa lamang na senador na si Antonio Trillanes IV na tumalima hindi lamang sa mga kautusan ng korte, kundi maging sa mga panuntunang ilalatag ng Armed Forces of the Philippines (AFP) at ni Chief of Staff Gen. Hermogenes Esperon.

Sa panayam kay Executive Secretary Eduardo Ermita, sinabi nitong kung anuman ang mga ipatutupad na kautusan ni Esperon kaugnay sa magiging set-up ni Trillanes sa pagpasok sa Senado ay kailangan ding mabigyan ng bigat.

Iginiit ni Ermita na bagama’t may hurisdiksyon ang sibilyan na korte kay Trillanes dahil sa kasong rebelyon na isinampa laban dito, hindi naman maaaring balewalain ang kasong paglabag sa Articles of War na kinakaharap ng Magdalo leader sa General Court Martial.

Matatandaang bahagyang nabitin ang proklamasyon kay Trillanes kamakalawa matapos igiit ni Esperon na kailangang humingi rin ito ng pahintulot sa Court Martial kahit pa pinahintulutan na ng Makati Regional Trial Court na makadalo ito sa proklamasyon.

Ikinatuwiran ni Esperon na maituturing din na may hurisdiksyon sila kay Trillanes dahil sa kaso nito na nililitis sa Court Martial.

“If that’s what the Chief of Staff said then that’s the way it should be,” pagsang-ayon naman ni Ermita.

Maliban dito, tumanggi na ang Kalihim na magbigay pa ng mas malalim na paliwanag sa isyu kay Trillanes dahil sangkot na rito ang mga legal na usapin, lalo pa’t ito ang kauna-unahang pagkakataon na ang isang sundalong nakakulong ay nahalal na senador.

A MILITARY lawyer yesterday said the Armed Forces might not allow newly proclaimed senator Antonio Trillanes IV, a former Navy officer who was among those who led the short-lived Oakwood mutiny, to attend sessions in the Senate.

Lt. Col. Jose Feliciano Loi said under the military justice system, detainees cannot leave their place of confinement.

Trillanes, who is detained at the Marines headquarters in Fort Bonifacio, Taguig City for the mutiny, is charged under the Articles of War, specifically for violation of Article 96 or conduct unbecoming an officer.

Trillanes is also facing a charge of coup d’état before the Makati regional trial court. The court has denied his motion for bail more than two years ago.

But the Makati RTC allowed Trillanes to leave detention to file his candidacy at the Commission on Elections office in Manila. He was also allowed to attend his proclamation last Friday although the military blocked his temporary release from detention by insisting that he also needed the military’s permission last Friday. AFP chief Gen. Hermogenes Esperon later relented and dispensed with the military permission requirement.

Loi cited the case of Rep. Romeo Jalosjos who was convicted of rape.

“Since he has no bail, he is detained, there is conviction. Although re-elected as congressman, he cannot attend the session in Congress. Probably, that will also apply to the good Senator-elect Sonny Trillanes,” he said.

Loi also said that under the Articles of War, military personnel accused before a military tribunal are not allowed to post bail.

“He may not be allowed to attend the sessions before the Senate if there is no court order or there is no approval from the GCM (general court martial.”

“There is no bail at the GCM, unless the convening authority (Esperon) will be liberal enough to give him temporary passes so that he can attend the sessions in Senate. I think it will be good for the democracy.”

Loi said there is no provision in the Articles of War which states that a detainee can be given temporary passes. “There is none. Once you are charged before a court martial, you are restricted to quarters. So if you are restricted to quarters, how can you attend the proceedings?” he said.

Trillanes was deemed resigned from the service when he filed his candidacy in February. However, the military retained its jurisdiction over him insofar as his case before the court martial because he committed the violation when he was still in the active service.

Trillanes, then with the rank of lieutenant senior grade, led about 300 junior officers and men in taking over the Oakwood apartments in July 2003.

Militant groups asked Trillanes to make good on his promise to investigate forced disappearances of activists and the existence of “death squads” in the Armed Forces, which are being said to be behind the killings of militants.

Trillanes, in interviews after his proclamation, said death squads were usually composite teams from intelligence units of the different service commands of the Armed Forces. He also said these groups operate “above the regular units” of the AFP and are used on a “case to case basis.”

The human rights group Karapatan has recorded more than 800 killings and nearly 200 abductions of political activists since President Arroyo assumed office in 2001.

The Bagong Alyansang Makabayan (Bayan) and fishermen’s group Pambansang Lakas ng Kilusang Mamamalakaya ng Pilipinas (Pamalakaya) said Trillanes should summon retired Maj. Gen. (ret.) Jovito Palparan, who was tagged by militant groups as “The Butcher,” and Maj. Gen. Delfin Bangit, chief of the Intelligence Service of the Armed Forces of the Philippines (Isafp), in the planned Senate investigation.

Renato Reyes, Bayan secretary general, said Trillanes’ statements confirmed the existence of “special intelligence units involved in the killings.”

“No other military officer, active or retired, has so far offered such a categorical and detailed description of these special units. Whether they are part of the regular uniformed units or not, these groups are likely enjoying the support of the military leadership that is why they are acting with impunity,” Reyes also said.

Palparan has been tagged by the Melo Commission as responsible for the killings under his watch as Army commander in Central Luzon.

Bangit has been summoned by the Commission on Human Rights to explain the disappearance of Jonas Burgos, an activist from Bulacan.

Initial circumstantial evidence shows military involvement in the abduction of Burgos.

“Bangit for his part should be probed for admitting the existence of a so-called Order of Battle against alleged enemies of the state. The OB is a virtual hit list as explained by United Nations special rapporteur Philip Alston in his report. The fact that this practice exists already shows the AFP’s complicity in the killings,” Reyes said.

Reyes said Trillanes should also convince his cavaliers in the Senate to support the probe into the killings, referring to Senators Rodolfo Biazon, Panfilo Lacson and Gregorio Honasan who like Trillanes are products of the Philippine Military Academy.

“As former members of the military, they should at least be concerned that the AFP has been tagged here and abroad as a notorious human rights violator. They should help in making the AFP leadership accountable under the principle of command responsibility,” Reyes said.

National security adviser Norberto Gonzales said government forces have nothing to hide if summoned in the probe.

He said they have faced several lawmakers and other investigating bodies over the issue in the past and Trillanes’ probe would be no different.

But Trillanes must first settle the issue of whether he would be allowed to perform his new duty as senator considering he has pending cases, Gonzales said.

“Let’s see what will happen…Wala naman kasing problema sa amin iyan, especially sa AFP… Let’s see how Trillanes will do his job. May problema pa nga (siya) kasi may kaso pa siya, so ang tanong, paano nga niya magagawa ang trabaho niya?” he said.

He defended Esperon, saying the military chief was only implementing military rules.

“He doesn’t want to jeopardize the court martial proceedings, unless magkaroon ng law reforming it. Dapat lang na suportahan ang mga sinasabi ni General Esperon,” he said. – With JP Lopez and Jocelyn Montemayor

Just look at the city of Las Pinas, the mayor there used funds by giving back to the people. Best City for several years. I had a transaction there once and I was amazed to enter city hall. It was like a hotel lobby with a server asking me what I prefer coffee or juice. And it was airconditioned to boot! Even funding a medical mission would be big. I would even volunteer to do daily charity work may it be consultation or minor surgery (I trained in surgery at Ospital ng Maynila) if you support it. I left 7,000 poor patients who still ask when “Dr. Libre” will come back. It pains me a lot esp. consultation fee is almost the equivalent of minimum wage. If a family will have a sick member they would not eat anymore because they still have to buy medicines on top of the PF of P300.00. I will pray that Senators Lacson, Trillanes, et al will change their minds about their pork barrel.

Justice officials on Monday urged senator-elect Antonio Trillanes IV to drop his plans to impeach President Arroyo for now and focus on helping the public especially the majority of the military who voted him into office.

A DZMM report said the officials, who spoke on condition of anonymity, said Trillanes would gain their respect and support if he sets aside his personal desire for revenge and focus on reforms in the Armed Forces of the Philippines.

Trillanes, 35, led a mutiny of young army officers against Mrs. Arroyo in 2003 due to perceived graft and corruption in the military and the administration.

While some of the mutiny leaders have reconciled with the President after making public apologies, Trillanes has remained unrepentant, criticizing Mrs. Arroyo’s government for widespread corruption and rights abuses.

He faces rebellion charges at a lower court in Manila’s financial district and several violations of the Philippine Army’s Articles of War before a military tribunal. If found guilty, he has to give up his Senate seat.

Trillanes has made no secret of his opposition to the government and to military top brass during the campaign, which he conducted from his jail cell.

“The only way for this country to move forward is to get Gloria out of the way,” a defiant Trillanes told reporters at his detention cell earlier this month.

“I’m going to live up to that advocacy, but if the people will eventually say no, then I am going to accept that as a fact.”

If Trillanes gets a seat in the powerful bicameral Commission on Appointments, he would have a say in the promotions of senior military generals.

He would also be able to block budget proposals for government departments.

The military said it was not concerned. “Why should we look at him as a problem?” asked military chief Gen. Hermogenes Esperon.

“People will now see that it’s better to take the constitutional way of doing things rather than creating trouble.”

But he said he opposed giving Trillanes bail and said the officer would have to appeal for a daily furlough from detention to attend the legislature.

“There’s no such thing as bail in the military,” Esperon said. “If we disregard the Articles of War, then we might as well forget discipline in the Armed Forces. Let’s forget that we have an army.” With a report from Reuters

MANILA — The Armed Forces of the Philippines (AFP) may prevent Oakwood mutiny leader Antonio Trillanes IV, who was proclaimed senator last week, from going to the Senate to attend sessions, a military lawyer said.

Lieutenant Colonel Jose Feliciano Loi noted that under the military justice system, Trillanes should not be going out of his detention cell as in the case of other personnel charged before the military’s general court martial.

Loi further explained that there is no such thing as bail in the military justice system.

“There is no bail at the GCM (general court martial), unless the convening authority (AFP Chief Hermogenes Esperon Jr.) will be liberal enough to give him temporary passes so that he can attend the sessions in Senate. I think it will be good for the democracy,” said Loi.

But Loi was quick to add that there is no provision in military laws, particularly in the Articles of War that allows the granting of passes to military officer and men who are facing charges before any military tribunal.

Trillanes is being tried for violation of the Article of War (AW) 96 or conduct unbecoming of an officer and a gentleman, an offense punished by dishonorable discharge from the service.

He was among the junior officers who led the short-lived Oakwood mutiny in July 2003. The mutineers occupied the Oakwood Premier hostel (now called Ascott) in Makati City principally to dramatize their protest against corruption in government.

Trillanes, who is detained at the Marine headquarters in Fort Bonifacio, Taguig City, is also facing a charge of coup d’ etat before the sala of Judge Oscar Pimentel of the Makati City Regional Trial Court (RTC).

Loi said there is already jurisprudence that would prevent Trillanes from attending the Senate sessions, citing the case of former Zamboanga del Sur congressman Romeo Jalosjos who was detained for a charge of rape.

“Since he has no bail, he is detained, there is conviction. Although reelected as congressman, he cannot attend the sessions in Congress. Probably, that will also apply to the good senator-elect Trillanes,” added Loi.

The 35-year-old Trillanes was proclaimed by the Commission on Elections (Comelec) as the 11th winner in the May 14 senatorial elections last Friday.

The military has deemed Trillanes resigned from the service when he filed his certificate of candidacy last February. He ran under the ticket of the Genuine Opposition (GO), whose seven candidates–-including Trillanes–won in the senatorial race.

Meanwhile, chief presidential legal counsel Sergio Antonio Apostol advised Triallnes to ask both the military and the court to allow him to attend sessions in the Senate as part of his duties as an incoming senator.

Apostol said Trillanes should have thought about the problem, including other possible consequences before he ran for public office to enable him to address it early.

He said Trillanes should also have known from the beginning that there is an existing provision that an office facing court martial is not allowed to leave military detention or his place of confinement.

Apostol said the military is merely doing its job in insisting on the strict observance of the court martial proceedings and military rules.

Apostol, meanwhile, shrugged off reports that two military generals would surface to help Trillanes in reviving the “Hello, Garci” controversy.

He said it is an old issue and if Trillanes intends to revive it, he better bring in new evidence and other proof. (VR/JMR/Sunnex)

Indeed the Filipinos should be educated on people in power who abuse Executive Orders and forces Charter Change in the throats of the citizens just to change our constitution for their own selfish and corrupt interests.

I still remember the magkaKAMPI clique with the expressed support of the administration who had wanted (and still wants) to remove their term limits as one of the first thing they wanted to achieve. Dreams of eternal rule by corrupting our nation’s Constitution. A sorry attempt towards a return to the Marcos dictatorial regime.
