THE TRIAL of President Estrada is the first case of a former Philippine president being accused, arrested and tried for alleged crimes committed during his regime. Our society has become polarized on this issue, and the impending verdict seems like a brewing storm looming over the horizon.
As it was, the ball fell into the hands of the Sandiganbayan, where a special division was created, to conduct a speedy and impartial trial. And rightfully so, due to the uniqueness and precedence of this case.
The aftermath of EDSA II, the force which catapulted Mrs. Arroyo to power, saw a third force which aimed at reinstating Mr. Estrada. Certain politicians rode the crest of this third force but abandoned it later on. A string of events occurred culminating in the violent dispersal at the gates of Malacañang.
This was the first feather on the political survivor cap of Ms. Arroyo.
The trial of Mr. Estrada on the charges leveled against him is already a part of history. The impending verdict, in my view, is a necessary evil to put a closure to this. It is therefore the duty of both opposition and administration elements in government not to inflame the passions of supporters but to let reason prevail. On this, let history be our judge.

True, thisdrama has to end. The only question is, ending just forending or ending with truth out.
A six years trial which mainly is based on a testimony of a criminal 130 million thief can not be very fair. Where the acte, stealing briber get free (and promoted)while the passive bribetaker is slapped with possible life term?
And why Atong Ang was not very credible as long as he did not testify against Erap but became immeiately very credible when he testified like the prosecution wants? The same now with Doble, he was not credible when he accused GMA but very credible when he retracted and now not credible again when he turned back to his first testimony.
Six years investigation and no real proof. Where are the billions? Why Chavit and Ang are not forced to show how they delivered the millions to Erap, when it has be shown already that it is not possible to pack that much bills in the boxes and then to carry about 90 to more than 199 kilo (depending on the denomination) through the very guarded entrance to Erap? Why nobody asked Chavit why he knew the most little detail of his ledger about payments to Erap but could not even remember who are behind his other codes of payments? Why this booklet has never been professional and independent checked whether or not the writing has appropriate age, matching with the written dates? Was the investigation so unprofessional or just not interested to check it because by failing to match, Chavit instead of Erap would have become the criminal? What if Erap, as long as still President, would also have issued EO’s which prohibits any official to testify or to attend any hearing?
Guilty or not, a fair trial has Erap not to expect, wonders excepted.

If found guilty Erap Estrada should immediately be brought to the Penitentiary but before going there should undergo the process of every person convicted. Would Erap feign illness to avoid jail? Would he play sick and claim that he has heart problem or an unknown malady?
Perhaps but I don’t think the court and the Department of Justice as well as the Bureau of Jail Management and Penology should just allow him. Otherwise this would be something of a special treatment not accorded any Juan, Pedro or Tomas who are immediately marched off to prison after being sentenced with conviction.
If found guilty Erap could file a Motion for Reconsideration within fifteen (15) days from today or file a file a direct appeal to the Supreme Court. Since the case of plunder is higher than 6 years in penalty he won’t be able to make use of probation. I also don’t think Erap would just sit by and accept pardon from President GMA- its more likely he’ll bite the hand if it was offered to him.

Is this good? I guess so. The economy being in shambles during the Erap reign was the main reason I joined the diaspora of my countrymen for alien shores. But was he worse that the Marcoses & the rest of their cronies who still hold key positions in our abused & blighted land? Or even those employed in our graft-ridden government offices. Erap is just a small drop in the huge ocean that is corruption which is destroying our country. I think for this to be an effective way of showing that corruption will not go unpunished is to not just to pat our backs & stop here. Otherwise, this would just be another hypocritical show. And as Gandhi says: “Corruption and hypocrisy ought not to be inevitable products of democracy, as they undoubtedly are today…”

I admit that I doubted that the Sandiganbayan would render a guilty verdict on the plunder case of former President Joseph “Erap” Estrada. So when the anti-graft court handed down the “guilty” verdict, it really came as a surprising relief. Now I will not discuss the merits of the case. I am not a lawyer. You can watch or listen or read the pros and cons over the media. And it can still be appealed. It is not yet final.
Let me focus on the rule of law instead. As a country, we thrive in shortcuts (whether in getting a driver’s license or in unseating the powers that be). We ousted two presidents already through “People Power.” Erap faced an impeachment court but it was cut short by a walkout. Then people massed in EDSA. The rest is… well, history. The problem was our shortcut short-circuited the legal process. In a sense, we ended up with a mob mentality, that is, we tend to force our way when things don’t go our way.
Whether we agree or disagree with it, we should respect the decision of the court because we are a nation ruled by law. Though they have the right to exhaust all legal means to appeal the case, I pray that the Erap camp will also respect that rule of law. I just hope that people who disagree with the decision would stop inciting more protests or would not provoke another uprising. We need to learn to submit to the law and go through the process no matter how unfavorable or tedious it may be. As a legal cliché goes, “The law may be hard but it is still the law.”
It is the same with the Word of God. Because God said it, that settles it, whether we believe it or not. The Bible may not go the way we think it should go, but we should go where it bids us to go.
The verdict is in. Let us move on.

Good Riddance. There was no fair justice here. For 6 years he did pretty much as he pleased. Lived a good life while awaiting trial in his luxurious rest house. He will probably appeal the verdict and drag this trial even longer. Then dying before he serves even a second in jail. After death, he will be revered as some sort of “Robin Hood” by the ignorant masses. Probably a street in Manila will be renamed after him. I can see it now, Joseph “Erap” Estrada Avenue.

The first statement above, I agree 100%. But with the second sentence, you just immediately overthrown your first statement. Delete it or retract it, is best. Retain it, then its not rule of law you’re talking about but your biased view.
Pardon those wordings, but it is what it is. You are praying for “Erap camp”, why not for all? Have you forgotten, those “lawyers” on Erap’s impeachment proceedings who “trashed” the law by staging a walk-out? The problem with Atty. Rufus Rodriguez and Atty. Saguisag when they talked to the press they were so sure of themselves of acquital. They even crowed that if Erap Estrada is acquitted then the Arroyo government of 2001 would not have any legitimacy. So now that the Sandiganbayan ruled to convict their client would they then change course and say- the Arroyo government is legitimate?
Well my good companyeros you should read Aesop’s fables- don’t count your eggs till they’re hatched. Now that you’ve mashed the two different things together- Arroyo government legitimacy and the fate of your client- then using the twisted logic- the GMA government is now legitimate.
Actually the Supreme Court has already ruled before that the GMA government is legitimate only you won’t listen. You prefer the logic- if Erap is acquitted and then the GMA government is not legitimate. But things went the other way around. I expect you to say- Erap is guilty the GMA government is legitimate.
History tells us that success has a hundred fathers and failure an orphan. That is clear today with the turnout of the crowd of supporters for deposed President Erap. It was a measly turn out. The crowd of Edsa Tres is visibly absent despite the clear rainless sky.
The problem with people like Erap they will only say the court is right if it agrees with them. Now he says its a miscarriage of justice. But he played with the court, appeared there, presented evidence, etc- and now they have the nerve to say its a kangaroo court, etc- etcetera. Had they won they would have said “Oh justice prevailed- there is still justice in this doomed world” or something like that. Well the game is you win- or - you lose- you stick with it.
Maybe Erap thinks the court is unfair- he should appeal this case to the MILF—or much better the NPA. Or perhaps to a Chinese court which just shoots the accused in the head. A bullet- because the government of China is saving revenue- but let’s move on.
The victory- is the victory of the people- even those who are for Erap should clap their hands. Its the People of the Philippines vs. Erap and we won. Seems Erap is alone by now in Tanay- soon a resident of Munti or Bilibid or if he wants Iwahig. Someone is suggesting building a jail in Tanay- well I could visit him I reside in Antipolo.
More to the point aside from the conviction- there’s a bonus. The monies of Erap almost half-a billion are now confiscated in favor of government even the house of his mistress- the Boracay mansion is also confiscated. So that’s a victory for us- whether we hate Erap or not.
This is not a game of I hate Erap- therefore I love Gloria. They can even go together- We’ve been clouded for a long time and our visions have dimmed. Its not a question of Gloria vs. Erap or vice versa- its the fight of the have and have nots in this country all along. Gloria will get what’s coming to her- but now let us deal with Erap.
Now we can say he really is a Plunderer- a Womanizer- Drunkard and now guilty of the crime without going through libel. Problem with him is he admitted it. If he’s my client- I would have to gag him and tape his mouth- before I would let him speak to the court- imagine admitting he’s Jose Velarde. So going out with my friends Atty. Ignacio, Atty. While there might be debates on what the extent the verdict means as a victory of the people, it is undeniably a victory of justice nevertheless since our judiciary has spoken its decision. Nonetheless, I am terribly bothered by the showing of our senators who seem to be bothered by the verdict on Mr. Estrada to the point of suggesting he has be given injustice. Is this what we should expect from the institution that has proclaimed itself “the last bastion of democracy”? The very irony exudes from the once-principled Senate President Villar, who was the speaker of the house that forwarded the impeachment complaint against then president Estrada to the senate. Of course, it was Senator Villar who also said that what he did then in the impeachment trial might have been a mistake. And you hear the rhetoric from the likes of Senators Escudero and Estrada [younger], expressing their implicit disbelief and mistrust on the decision of the Sandigan Bayan Special Division. This is a poor showing from our Senate, who instead of highlighting the success of the justice system and its implication on the present questions hovering the Arroyo administration, had to say that they felt sad over the conviction of a criminal: Mr. Estrada. I shake my head in disbelief. While I do agree that special treatment must be given to a former head of state, I however stress that never should such privilege be extended to a criminal. Mr. Estrada has done the country extensive, probably even irreparable, damage and he deserves the humiliation and disgust for abusing his power. Once a former dictator got away, deposed but got away. Never again should a plunderer be free, rather he should have confinement for life.

Justice Prevails!! As I heard the verdict on TV I said YESSSS…I was there during EDSA2 and I was proud to be part of it disposing a corrupt president. Let him experience what is to be a inmate at Muntinlupa (Maximum security compound) we are the only country who treats corrupt politicians with a luxury villa, nobody is exempted from serving sentence in jail after a conviction, not even a former president. Other countries have former prime ministers or presidents convicted and then jailed. Why can we do it here in the Philippines? ERAP GUILTY!!!!

The Philippines is one on the most vibrant democracies in Asia. The latest decision of the Sandiganbayan to convict Erap of plunder after six years of trial is just one reason that justice prevails in our country regardless of one’s status in politics.
Rene Saguisag, one of Estrada’s attorneys, added: ”In its heart of hearts, it was a case of guilt not proven.” I beg to disagree. I thought he is a very intelligent lawyer. The defense panel has all the chance to present their arguments in the (kangaroo?) court but they failed to do it. They presented 76 defense witnesses but they can’t prove that their client is innocent. Well done Dennis Villa-Ignacio. You are smarter than Rene Saguisag and Estelito Mendoza combined.
Well, I am not a lawyer but at the very start of the case I can foresee that Erap is guilty of plunder “beyond reasonable doubt” and that prediction proves right.
Then, who’s next? In my opinion treason/espionage is more serious offense than corruption. What about the “Hello Garci” tapes? Well, the subject here is about wiretapping and not who’s wiretapped. Wiretapping is a serious crime and of course, punishable by law. Mr. Doble (ang mistress) must be charged with wiretapping but not as a witness, (just what happened in the ongoing Senate Inquiry).

Well, true that complete justice is still to be achieved, we should never discount the piece of justice upheld and won in the Erap Conviction. While it is still a long way to convicting all corrupt officials, the conviction of Erap is still a milestone. Instead of looking at this moment with a sigh of doubt because of the seemingly insurmountable task before us, let us look at this point of our history with a sigh of relief that hope is still alive. In the Philippines any person is considered “innocent unless proven otherwise”, right? Now that Erap is proven “guilty beyond reasonable doubt”, do we have to go to the steets like mobs in order to prove the world that he is innocent and the “kangaroo” court is bias in their decisions? Just asking. Did you know that in Greece any person who commited a crime is considered “guilty unless proven otherwise”?

In the news, Estelito Mendoza is blaming some Jane and John Does for what happened to Erap. What a crap! Were they gagged during the presentation of their arguments. Erap was the President of the Philippines during the time the crime was commited. Another thing is aside from Clarissa Ocampo, the star witness, they have Chavit Singson. In criminal law, the best witness to thump down the defense is somebody who is a friend, a relative or any other person close to the accused. In this regard, the prosecution has.. in the person of Mr. Chavit Singson who was Erap’s drinking and gambling buddy.

Now it is out, Erap is sentenced for plunder.
Plunder? The cases that are the basis of the conviction do not involve any PUBLIC money, which is what only makes a case ‘plunder”. The only plundered money has been Chavit’s frauded tabac tax, but Chavit is free and Erap acquitted on this proven false accusation. And the other basis case, the BW kickback, did not go to Erap, at least there is no proof. And the alleged millions to the Erap fund for Muslim youth, his lawyer was acquitted about and if still the money went to the registered fund, it was out of Erap’s control. Lastly the billions at the Velarde account? He is acquitted of being Velarde and it is proven by bank vice-presidents that the account was opened, maintained and owned by Dichaves.
So, what is then the plunder money from public sources? What would remain in a fair trial, if it woukd have been proven, would be graft or corruptin, but never plunder.
Jueteng money? It has been witnessed that the money went to jinggoy but Jinggou is qcquitted about this, so how can his father be sentenced for plunder for the same case? How culd money have personally delivered to him at Malacanang when it is proven that at the witnessed time he has not been there?
A victory of law and democracy? What a shame. All it is, is not more than a victory of opportunities, because otherwise GMA and the inventors of EDSA II could be charged of plotting a coup, admitted by GMA, and also of destabilisation, sentence life term…..

The GMA administration is not a legal government.
The law was broken when Estrada was forced to quit his presidency without due process of law, therefore, from then on, any presidency that takes over is a bastard presidency, no matter how much numbers are hyped.
I have no love for Estrada.
Personally I think he is a disgrace to the Office of the Presidency, and he disgraced Malacanang, if what I heard about the “toma-tumba-suka” sessions inside the presidential palace were true at all.
But the rule of law was not followed in his ouster.
Therefore, technically, he is still the president, and we are guilty of injustice to a duly elected president, elected without the usual violence, massive vote-buying, and cheating that marked other Philippine elections.

We presume the court arrived at its decision after careful evaluation of evidence presented during the trial.
The Black & White Movement, however, laments the selective application of justice - expedient and with a heavy hand for those perceived to be enemies of the GMA regime, while slow and protective toward those allied with her.
What is the difference between Jose Velarde and Jose Pidal?
Why has this government not pursued the cases against Nani Perez, Joc-Joc Bolante, Virgilio Garcillano, and more recently, Benjamin Abalos’ alleged complicity in the ZTE deal? Instead of pursuing these cases, this administration has stonewalled through gag orders such as the illegal EO 464 and questionable MO 108.
This reflects the sad state of our justice system where political patronage is the rule of the day. Those out of favor with the powers that be are prosecuted while those in the inner circle are beyond the reach of the long arm of the law. As former President “Erap” himself has put it… “weather-weather lang.”
We can only hope that when the political winds change direction, those who are currently in the circle of power, who are allegedly involved in crimes more sinister and heinous than Erap’s plunder, will have their day in court.

Our politicians have been too comfortable in ignoring what is wrong. Regardless of party or personality inclinations, putting a big fish into jail is a good sign. The only problem about the Estrada conviction is that what has been supposedly dealt with by Justice was in fact desperately tainted with politics.
But there are other political signals that have been taking into form lately, and they are good signs. Electorate spending is no guarantee for office. Voters can turn elections into a referendum. Government tong is again scandalous. Most important of all, no politician is safe from Bilibid, considering that many of them acquire political foes as the price dictates.

The freedom of speech under the Constitution guarantees or otherwise protects, among other things, the right of privacy or “ leave me alone.” Republic Act 4200 or otherwise known as the “Anti-Wiretapping Law ( “ Act 4200) further strengthens the right of privacy by punishing among other things, recording or tapping of a private conversation or communication of “ any” private person.
Senator Canada has intended and the Act 4200 itself is clear, that the right of privacy protects (1) the act of invading the right to privacy and, (2) the private nature of a conversation or communication. To the extent that Act 4200 punishes the act of secretly recording a conversation or communication which is private in nature makes the law malum in se. Thus, a mere recording or tapping without the consent of the two parties concerned is punishable by Act. 4200 and the contents of the recording whether legal or illegal are not relevant to establish a violation
If the recording is illegal then any and all conversations or communications are also tainted. The spring cannot rise more than its source.
Let’s examine what Senator Canada said:
Senator Canada: As I have said, your Honor, the purpose of this Bill is to prevent the tape
recording or interception of a communication between one person and another- not between a speaker and a public. Because, precisely, the speaker speaks so that the public may know what has in mind and there should be no objection to tape recording that speech. But we want to protect is the communication between private individuals.
Senator Diokno. Then will it be possible to clarify this? Would your Honor have any objection to clarifying Sec. 1 as indicating communication or spoken word between private individuals.
Senator Tanada.Well, if you believe that is necessary although I believe that the very purpose and objection of the bill, as may be seen from the different provisions of the bill, clearly indicate thatintention- and that is the tape recording of private conversations or communications between one person and another.

The intention of Sen. Tanada is clearly to cover private conversations or communications between two government officials as long as they are made in private. Since, the call from the President to a COMELEC official was privately made and relating to private matter, the President is protected by the Anti Wire Tapping law.
The President was not performing her official function when she placed a private call to a COMELEC official. At a time, she was not exercising his function as the President. Neither did she commit any crime nor had violated the Election Code when she placed that private call. On the contrary, she was the victim of the crime. Evidence shows that the military bugged the conversation of the President and other private citizens, public officials and employees without their knowledge and consent.
The act of getting or securing political information as well as the information itself purposely to protect her political interest during the canvassing of the election results, is not a matter of public concern. Having said that, GMA’s right to privacy should be respected because it is protected by the R.A. 4200 and the constitution as well.
Also, since the law is clear as the extent of its nature, limitation and application, there is nothing to clarify and there is no need for judicial inquiry. Such inquiry is merely intended to satisfy the political whims and caprices of the opposition Senators.
The tapes are now in the hands of the Senate and the contents of the tapes are now known not only to the Senators but to the public therefore, it is pointless to conduct further legislative inquiry. From the information that is available to the Senators, they can now introduce amendments if any, to the Anti-Wiretapping Act or Elections Laws. Digging further the tunnel is no longer necessary. For in doing so, it would only create constitutional challenges thereby destabilizing the government.
There is no case in the Philippines relating to this issue.
The U.S. Supreme Court held in Barnicki v. Vopper case that the federal anti-wiretapping statute is constitutional because it is a law of general application and does not violate the freedom of speech. I that case, the court by majority votes, held that the right of privacy was not violated because (1) respondent media did not take part on the illegal interception, (2) the respondents’ access to information on the tapes was obtained legally, and Third , the subject matter of the conversation that inadvertedly overheard by a third party was a matter of public concern.

However, this Bartnicki case is distinguishable and inapplicable to R.A 4200. First, unlike the federal anti-wiretapping statute, violation of R.A is malum in se. Intent need not be proved in order to hold the perpetrator responsible for violating R.A 4200. Second, R.A. 4200 specifically protects private communication or spoken word wether or not it is a matter of public concern. In Bartnicki, the Court said that months of negotiations over the proper level of compensation for teachers at the Wyoming Valley West High School were unquestionably a matter of public concern and respondents were clearly engaged in debate about the matter. Third, in Bartnicki, illegally obtained information is not protected by the First Amendment of the Right of Speech, because the information itself is being suppressed. Fourth, the third party inadvertedly overheard the statement. Here, the military intentionally intercepted the private conversation of the President.
Senator Tanada intended to give strong protection to a private communication or spoken word under the R.A 4200 if committed by a “ peace officer” By adding Sec. 4 to the effect that “ any communication or spoken word, or the existence, contents, substance, purport effect or meaning of the same of any part thereof or any information therein contained obtained or secured by any police officer shall not be admissible in evidence in any judicial, quasi-judicial, legislative, or administration hearing or investigation, Senator Tanada tightened the screw against abuses of right to privacy by a peace officer.

There are many here who question the guilty verdict. Did anyone ever read the whole decision? I did from page 1 to the last. And if I were the sitting judge based on the evidences presented for and against, I would also find Erap guilty beyond reasonable doubt.
The prosecution did a sterling job in showing Erap’s plunder. The defense lost the case for Erap and Erap unwittingly (I don’t why he did it) put the last nail in his own coffin by admitting under oath that he was Jose Velarde. The guilty verdict hinged on the Velarde account and not on the jueteng testimony of Chavit Singson.

RP one of the most vibrant democracies? Do you ever know what “democracy” means?
It means the people rules, not an elite and not a military backed government oor anything else. And it means that everyone can freely express his or her sentiments, grievances, critics. There is no room for gagging EO’s for to suppress any investigation into questionable deals, graft, corruption, crimes.
What would have happened if Erap would have issued such gag orders to suppress any investigation? He let the matter go, very contrary to now. If really he had that billions, he would have the same easily bought the numbers in congress to squash any impeachment.
And now? Chavit admitted to have taken 130 million public money, which is plunder. Erap is acquiied form these accusations that he got the money, which anyway has been proven impossible since it could never fit into Chavit’s boxes and would weigh at least 100 kilo, first to show how one would have carried it from Chavit’s car to Estrada’s house through the PSG agants. But did now anyone ask where then the money went? Taken by Chavit but not delivered to Erap, so still with Chavit? He would be guilty for real plunder plus for false testimony to the court. Is there any case, any arrest warrant?
Velarde? There are two vice presidents of the bank who witnessed that Dichaves opened, owned and maintained the account, not Estrada and Erap is acquitted from being Velarde.
That lady that testified she delivered personally to Erap money, at a time when, due to official records, Erap was not even there?
Jueteng money? Where is anyone who testifies he gave protection money for Estrada?
Chavit’s ledger? He could put there anything he want, really not any proof that it is real. Besides, would really anyone make and hold such ledger, which at any time could have been turned out as undeniable proof of plunder, bribe and other crimes at a time when death penalty was still a possible sentence? Only a very stupid criminal would do so and Singson does not seem to be that. Why he did remember anydetail of the alleged Erap deliveries but could not remember whois behind the other coded recipients, they all would also be punishable.
We should remember that Singson turned against Estrada after Erap wanted to impose a legal number game instead of Chavit’s main income through the illegal kind of number games, therefore bypassing Singson.
However, if Estrada really would have committed all the crimes, then nothing of all has been really and truly proved.

Whether wiretapping is “legal” or “illegal”, Gloria’s indiscretion is grave enough for her to relinquish her post. We go around willy-nilly on it’s legality or illegality but Bunye himself released the contents to the media for all to hear. As usual this supposed “illegality” is being used by the administration to use the “letter of the law” instead of honoring the “spirit of the law”. As such Gloria herself should have resigned after this incident.
To add, the Lower House’s congress move to smother the issue and prevent proper investigation simply reflected how morally bereft they are. As such this nation has become a nation of institutionalized cover-ups. It is by this very fact that many people in top positions use this same style to hold on to their post for selfish interest tossing away the once effective cultural check and balance … “Delicadeza”. This new culture of using executive powers to cover-up any investigations on corruption is the very thing that rends asunder the very moral fabric of the Filipinos.
As in the allegory, the wife should have accepted her indiscretions to her husband rather than lamely blaming the “peeping tom” who discovered her sin.
Gloria should have taken the honorable way out, she should have resigned than perpetuated this practice of institutionalized cover-ups. No, these acts committed cannot be eradicated by good lawyering, legal technicalities and executive powers. One cannot hide from ones deeds for there is Higher Power who sees all that takes place.
She should have spared this Filipinos of the new reinvention Gloria and her administration had spawned institutionalized cover-ups, de-facto Martial Law acts, and protection of corrupt allies even to this day. She should have shown the Filipinos the good example of admitting her mistakes and resigning so as the citizenry would know how to act honorably, a new moral advent in Philippine society. I do give Erap some merit for having the courage to go through the judicial process. Unlike Ninoy (Aquino) who was willing to compromise and went to Boston instead of staying home ( The Philippine Heart Center was adequate to take care of him).
Erap can serve the Filipinos more by going through all the way—-accept the punishment of Plunder—by sitting on the electric chair!
In so doing perhaps our poliicians will think hard before plundering the country’s future.

The real question for eraps trial would be has jueteng activities eradicated?, as for my own opinion the real losers here are the GSIS and SSS members like myself, who lost their pension funds that bought the belle resources stocks that is now worthless, ($3,14 per share). that stocks was originally set to tackle Jueteng Activities by making it legal as the former presidents intention(that would have double its value) and the members will benefit, instead the jueteng lords are the one who are making millions, and i myself saw one jueteng lord who gamble in Starcity casino with millions of dollars of funds and quiet well known with the GMA government a hero of edsa2, he has a yatch that sometimes dock in Darling harbour in Sydney Australia. In every country or state, there are state secrets that must not be known publicly. We elect these Senators to make, pass and amend laws not to investigate. Why not give this job to the Supreme Court?
Chavit Singson was a gambling and a drinking buddy of Erap turned state witness. He was not the accused either. The burden of proof lies on the prosecution panel and they prove it on the court not in the media as what Mr. Saguisag and Mr. Estelito Mendoza did. The prosecution just did their homework very well that is why the Sandiganbayan voted unanimously to convict your guy.

I think the verdict to Erap is not yet that what we call the exact justice. And yes there is a distinction of treatment considering his status being of a former president. But the way I see it, he is an over-pampered and over-spoiled prisoner.
Our justice system is not yet in its true form. But I believe our justices has done a great effort to follow their moral convictions in these landmark decisions considering the extreme bias political forces reigning in this land for a long long time now. Its a first in history that they convicted a well-oiled and very popular big fish- a former president at that- beyond the ill-twisted norms…Still remember the Marcoses, what they had done? Those boxes and boxes of newly minted money they brought along on their escape? How about Imelda Marcos dipping her hand on her personalized piggy bank (PNB) for her shopping sprees in New York? Out of delicadesa the Swiss banks had already returned that billions of money because it was proven that the Marcoses stolen it. 21 years later still the justice system could not touch Imelda Marcos, despite the many cases filed against her in court. But instead the government has the nerve to enter into a bargaining agreement for that stolen money. Where is the DIGNITY on that? And now its Erap turn. We have never learned thats why its always happening.
My kudos to the prosecutors especially to those volunteers who rendered their services for free because of their convictions to give the justice system a breathing chance in this time of political circus and defy the odds. Same with those witnesses who risk their lives being on the hot seats to speak the truth.
And together with the Sandiganbayan justices, they should be given recognition and a place in history for that matter.

In the Philippine present judicial system, conviction in court is only applicable to official who are in the opposition and persons against the government. I haven’t read of any pro government officials convicted of graft & corruption?. What happen to the Hello Garci tape case?

After all this Former President Eraps fiasco, i could not believe it to what is happening to our GSIS and SSS funds where i beleive the Senate is planning to invest the funds overseas to make money out of it. Most of our kababayan never realized that Pagcor is the only government controlled business that is making money and yet when Erap tried to create Belle Resources stocks with SSS and GSIS funds, he is now convicted by the Sandigan Bayan and yet He categorically said he will return the money about 545 million pesos and 200 million pesos which should be used to buy Pagcor stocks instead of investing overseas where its quite volatile and risky, compare to profitable Pagcor stocks where it can be specifically used as a tool to fight Jueteng activities. So where is the logic about Eraps mesh.

If found guilty Erap Estrada should immediately be brought to the Penitentiary but before going there should undergo the process of every person convicted. Would Erap feign illness to avoid jail? Would he play sick and claim that he has heart problem or an unknown malady?
Perhaps but I don’t think the court and the Department of Justice as well as the Bureau of Jail Management and Penology should just allow him. Otherwise this would be something of a special treatment not accorded any Juan, Pedro or Tomas who are immediately marched off to prison after being sentenced with conviction.
If found guilty Erap could file a Motion for Reconsideration within fifteen (15) days from today or file a file a direct appeal to the Supreme Court. Since the case of plunder is higher than 6 years in penalty he won’t be able to make use of probation. I also don’t think Erap would just sit by and accept pardon from President GMA- its more likely he’ll bite the hand if it was offered to him.

A TIME FOR MOURNING
Today will be marked as a miserable day in our nation’s history. Gloria Macapagal Arroyo’s pardon of former president Joseph Estrada, granted without need of a public admission of guilt, is a mockery of justice and an insult to all Filipinos. It is a reflection of the culture of transactional politics that has characterized GMA’s regime, which has brought our country to a state of moral bankruptcy.
We ask every citizen to join us in mourning the death of justice in our country. Tie black ribbons to your vehicles and wear black every Friday starting today. Let us paint this nation’s heart black, for that is its color at its core. Those in government who often claim respect for the rule of law and who are sworn to uphold it are the very ones who pervert it.
Let us also stop according our government officials – the President, Vice-President, Cabinet Secretaries, Senators, Congressmen, Governors, and Mayors allied with GMA, the honor they do not deserve. Ginagago na tayo. The least we can do is to STOP calling them “honorable”, refuse to shake their hands, or stand up or clap for them at their public appearances.
Each one of us should ask our Governor, Mayor, and Congressman of whatever party affiliation, “Pumunta ka ba sa Malacanang?” and “Nakatanggap ka ba?” With the ease by which they offend our sensibilities and basic decency, they deserve no less than our ostracism.
To our OFWs who have kept our economy afloat with your sacrifice and hard-earned remittances, we ask that you express your outrage through emails that you are so good at sending out around the world. Please send messages of indignation to Philippine embassies and consulates in your host countries. Work to use your influence over your families to boot out corrupt officials in 2010. Help us express global outrage at the impunity with which an illegitimate president rules.
Sadly, the reason we are in this state of moral bankruptcy today is because we have been indirect accomplices in the past through our silence.

What is seen as a “third force” in there is no third force at all. It is the Estrada camp that was emboldened and bolstered by public dismays for the Arroyo administration.
Third force in the Philippines would be those, or those representing people who are sick of corrupt forces squabbling among themselves-on who of them should plunder the nation.
If a line between right and wrong is drawn today, The Estrada camp and the Malacanang camp will find themselves in one side and a TRUE third force will be the other side.
There is only EDSA 1 and EDSA 2. There were revolutionary attempts against the Arroyo administration that failed. Third force took the stance of wait and see. The prospect that Estrada was to be reinstated to power simply turned them off.

The standard of morality, ethics and professionalisim are so low that those who are influential. rich and powerfull use them to their advantage. President Arroyo’s granting of pardon to a convicted plunderer like Estrada is a mistake in any form. If she desires reconciliation for granting pardon to a most undesirable former official like Erap and all his troublemaker supporters, then she’s absolutely wrong. With this recent Manila pen’s fiasco and attempted power grab by Trillanes and Lim, I can sense another collaboration with the group of estrada directly or indirectly.
Given the fact that Estrada is politically illeterate and so his paid supporters, he will not stop in doing everything possible to revenge on GMA for his very humiliating ouster from power in 2001.
I will support President Arroyo or the next leader to impose an iron fisted rule to the entire country If it is deemed possible just to put our nation on the right track. Our nation had gone nowhere because of political immaturity of our politicians and people. Thailand, Malaysia and now once bankrupted Vietnam are bypassing us in terms of economic development because Filipinos tend to focus on dirty politics and selfish quarellings rather than build sustainable economy, we also lost our moral obligation to love dearly our beloved country.

it must be very annoying for you on how and why they use foreign language (i.e english )in motherland by the majority of the govt. officials and the tv network personnel in conducting their daily business and comms. with their constituents and audience. the way i see it, the use of tagalog dialect only will put diservice to the folks in ilocandia, bicolandia, the waray and ilongo speakers from the motherland. the phil. is the land of many tounges. afar from metro-manila area are our countymen that have to learn tagalog because it is the national language, and to learn english because it is use as the form of instruction in most secondary and higher learning institutions.
born-tagalog dialect users are not obligated to learn other dialect like the ilocano or cebuano dialects to get by and be part of the filipino mainstream society.
so in order to give credits where credits are due and also i think it is safe to say that the heavy accented english usage of modern juan dela cruz seems to be the norm today and in years to come. the reasons are that in order for the many filipino multi-dialect speakers to have their idea expressed and communicated their ways and thoughts with their multi-dialect listeners the mechanical english usage is not avoidable.
i hope that i get my point across and not to gloss over the issue here.

MANILA, Philippines—Romulo Macalintal, President Macapagal-Arroyo’s lawyer on election concerns, said the opposition would be committing “suicide” if it decided to field deposed President Joseph Estrada for the 2010 presidential election.
“During the entire duration of the campaign, (the opposition) will be busy answering the petition to disqualify him and convincing the people he’s still qualified,” Macalintal said.
He compared Estrada’s situation with that of then presidential candidate Alfredo Lim when his citizenship cast doubt on his legitimacy as a candidate in 1998.
The election lawyer also expressed doubt that the opposition would manage to come up with a single standard-bearer in 2010.

“The administration will only be too happy to see Erap run in 2010 with (Senate President Manuel) Villar, (Sen. Manuel) Roxas and (Sen. Loren) Legarda dividing their votes, to the advantage of the administration candidate,” Macalintal said.
He also said that it was “improper” for an official of the Commission on Elections to comment on the legality of Estrada’s plan to run again for president.
He said election Commissioner Rene Sarmiento may be asked to inhibit himself from deciding on the Estrada issue should it reach the Comelec in 2010.
Macalintal and Sarmiento incidentally shared the view that the Constitution bars an elected former President from running again for the same position.
Both lawyers said that Estrada may run for any other elective position except for president.

“With due respect, Commissioner Sarmiento should refrain from making such comment. In the future if the issue is brought to the Comelec, he could be inhibited due to such premature position made publicly,” he added.
Macalintal went on to say that Estrada may still become President but only through succession. He said he may run for vice president and if he wins, may succeed the elected President should the latter die, resign or be removed from office.
In Malacañang, Executive Secretary Eduardo Ermita said the administration could start focusing on the 2010 presidential election in the second semester and at the latest, the last quarter of 2008.
He said though that the Lakas-CMD would be holding a meeting either on Jan. 7 or Jan. 8 to “prepare the party’s strategy’’ for 2010.

Events in 2007 show that the political crisis that almost resulted in the ouster of the Macapagal-Arroyo administration in 2005 is far from being resolved. It has, in fact, worsened in 2007 as old issues continue to hound it and new scandals have emerged.

The Gloria Macapagal-Arroyo administration must have expected a calmer year this 2007. After all, local and national elections were scheduled in May; it had sent a chilling message to all in 2006 that it would preempt all attempts at ousting it by bearing down hard on those who would dare to; and time is on its side, having completed half of its “term” thus, the opposition may be convinced to just sit it out and wait till 2010.
But what happened was another turbulent year for the administration. Old issues kept on hounding it and new issues began to emerge. And before the year ended, it was adjudged the most corrupt president in the country’s history, surpassing even the much-hated Marcos dictatorship, and its satisfaction rating slid even further. According to the surveys of the Social Weather Station, Mrs. Arroyo’s net satisfaction ratings went down from -4 and -3 during the first two quarters of 2007 before plunging to -11 during the third quarter and -16 percent for the fourth quarter.
Before that, the Filipino people have already shown indications of restlessness. In a Pulse Asia survey in October, seventy percent of the Filipino people wanted that further investigations on the controversial ZTE contract for a National Broadband Network (NBN) be conducted; 61 percent are willing to sign a petition letter calling for the resignation of a president who is involved in corruption; 27 percent are willing to join rallies; 26 percent re willing to speak out during rallies against corruption; and 25 percent are willing to do whatever is necessary to oust a corrupt president.
Elections
Historically, elections had a way of releasing political steam. The attention of the general public is diverted to the elections; and it provides a venue where the administration and the opposition can compete and settle their differences and tensions peacefully.
Unfortunately for the administration, the May 2007 elections resulted in the opposite. The people vented their ire on the administration, through the elections, by dumping senatorial candidates who are identified with Mrs. Arroyo. Progressive party-list groups who were the targets of an operation to deny them seats in the Lower House through an operation of the Armed Forces of the Philippines (AFP) retained five seats from their previous six. The Commission on Elections (Comelec) even lent a helping hand by suddenly experiencing an epiphany and enforcing the first party rule that limits the granting of the maximum number of seats to the party-list which topped the elections (This ruling known as the Panganiban formula has been in existence since the 2001 elections but was never implemented probably because Bayan Muna topped the 2001 and 2004 party-list elections.)
But what did the administration in was its desperate efforts to preempt its trashing in the elections. It fielded Malacañang-sponsored party-list groups. Worse, it committed massive electoral fraud, using the same machinery - the Comelec in the Autonomous Region of Muslim Mindanao - that it used during the fraud-ridden 2004 presidential elections. Expectedly, the public discovered it immediately and the successor of former Comelec Commissioner Virgilio Garcillano, who was thrust to the limelight because of the Hello Garci tapes, as key operator in these fraudulent operations was quickly exposed namely, Maguindanao elections supervisor Lintang Bedol.
This provided the impetus for the revival of the investigation on the “Hello Garci” tapes, which recorded cell phone conversations between Mrs. Arroyo and then Comelec Commissioner Garcillano when they were plotting to ensure that she wins by a million votes versus the late Fernando Poe Jr. in the May 2004 presidential elections. Taking the cue from this, Sen. Panfilo Lacson resurfaced T. Sgt. Vidal Doble who testified to the authenticity of the controversial tapes. Questions regarding the legitimacy of the Arroyo presidency were revived.
The opposition-dominated Senate threatened to investigate all unresolved issues involving the administration such as the fertilizer scam, among others. The Macapagal-Arroyo administration tried to ignore these issues dismissing it as ‘politicking’. But before the issue died down, Jose De Venecia III, son of House Speaker and Arroyo ally Jose De Venecia, came out with the explosive expose’ that then Comelec Chair Benjamin Abalos Sr., helped by Mrs. Arroyo’s husband Jose Miguel Arroyo, tried to corner the overpriced NBN contract for ZTE of China through bribery and threats.
Because of the expose’ on the involvement of Jose Miguel Arroyo, the scandal regarding the controversial NBN-ZTE contract knocked right at the doors of Malacañang.
Impeachment and bribery
To preempt the filing of another impeachment complaint against Mrs. Arroyo on the basis of the NBN-ZTE contract, the administration again used the same ploy but this time hiring Roel Pulido to replace Marcos lapdog and look-alike Oliver Lozano in filing another weak impeachment complaint. So when a genuine and stronger complaint was filed it was promptly rejected by Arroyo’s paid hacks in Congress citing the provision that only one impeachment complaint may be filed against a government official in a year.
But the ploy backfired on the administration. For one, with the filing of another complaint, Mrs. Arroyo earned the distinction of having the most number of impeachment complaints filed against any other Philippine president in history. Worse, the Arroyo administration tried to buy the cooperation of Lower House representatives and local officials. First, it tried to dangle the release of pork barrel funds to obtain the cooperation of congressmen. This bribery attempt was promptly exposed by Anakpawis (toiling masses) Rep. Crispin Beltran. Then it distributed bribes to representatives and local officials amounting from P 200,000 to P500,000 ( $4,816 to $12,042 at an exchange rate of $1=P41.52) right inside Malacañang in a meeting the administration called last October 11. This was exposed by the governor of Pampanga Ed Panliliio who is also a priest. The Macapagal-Arroyo administration could have been so desperate that it tried to bribe even a militant lawmaker and a priest.
These brazen bribery attempts revived calls for Mrs. Arroyo’s resignation or ouster.
Extrajudicial killings and enforced disappearances
But Mrs. Arroyo’s woes did not stop with the Malacanang bribery scandal. As November was coming to an end, UN Rapporteur on Extrajudicial killings Philip Alston released his final report, which pointed to the AFP as the culprits behind the spate of extrajudicial killings and enforced disappearances. And while Alston recognized the efforts of the Arroyo administration such as the setting up of the Melo commission and designation of special courts, he concluded that the killings are part of the government’s counterinsurgency program dubbed Oplan Bantay Laya (Operation Freedom Watch). He also criticized the wrong sense of priorities of the Department of Justice which expended a lot of efforts in running after the victims - progressive party-list representatives and leaders of people’s organizations identified with the Left- rather than the killers.
The subsequent granting of petitions of writs of amparo for leftists abducted by the military confirmed the conclusions regarding the involvement of the military. This was further strengthened by testimonies of two farmers who escaped from military custody. They confirmed suspicions that missing UP students Sherlyn Cadapan and Karen Empeño are likewise being kept by the AFP. The enforced disappearance of Jonas Burgos has also been a thorn on the side of the AFP and the Arroyo administration. All indications, including the license plate of the van used in the abduction, clearly point to the culpability of the AFP.
Political crisis
Events in 2007 show that the political crisis which almost resulted in the ouster of the Macapagal-Arroyo administration in 2005 is far from being resolved. The Manila Peninsula standoff, which many considered as an ill-prepared and futile effort, nevertheless showed that all is not well even within the AFP.
The crisis has, in fact, worsened in 2007. The piling up of cases and scandals involving the Macapagal-Arroyo administration has again put it in the defensive. Old and new issues continue to hound the Arroyo government and the efforts of the administration to push these aside are becoming more and more difficult. Cracks within the ruling party are now showing with the expose’ of Jose de Venecia III. These have put the Arroyo government in a desperate position thus, its brazen attempts at bribery. And its recent moves to “shock and awe” opposition to its rule, through the use of repressive and intimidating actions and measures merely backfire. Examples of this are the strong criticisms it got in its handling of the Makati standoff, which included the arrest of journalists, and in Mrs. Arroyo’s proposal to revive the Anti-Subversion law.
The movement calling for the resignation or ouster of what is now called as a “morally bankrupt” government is again gaining ground. The question now is, “Will the Arroyo government survive till 2010?” All indications point to the further worsening of the situation in 2008. But much depends on the momentum of the people’s movement for the ouster and resignation of the Macapagal-Arroyo administration.
If the Arroyo government survives 2008, time will definitely be on its side. By then, preparations for the 2010 presidential elections will be underway. But the crisis it engendered will only become worse. This may lead to the weakening of the institutions of government and the radicalization of the Filipino people. Bulatlat

Erap, opposition spokesman clash on 2010 race plan
Former president Joseph Estrada said Wednesday that he would no longer seek a new term in Malacañang during the 2010 presidential election.
The United Opposition’s spokesman, however, said otherwise.
“Kung di mag-unite ang opposition, President Estrada is open to run for president…we have to learn lessons from 2004, sa dami ng opposition na tumakbo, natalo din (If the opposition won’t unite, President Estrada is open to run for president…there were many opposition members who ran, but lost in the end),” lawyer Adel Tamano said.
Estrada, however, said: “That’s speculative. I’ve no intentions of running….[I] am here to consolidate the party….but am not closing my doors.”
“I’ll think about it, let’s cross the bridge when we get there,” he added.
Cagayan de Oro City Rep. Rufus Rodriguez, an Estrada ally, meanwhile, echoed Tamano’s statement.
He said that with too many opposition leaders who have intentions to join the presidential election in 2010, Estrada might be forced to declare his candidacy to unite the opposition.
“…with the kind of situation where there’s too many political parties. The LP (Liberal Party) is now posturing with Mar Roxas; the NP (Nacionalista Party) is now organizing with Manny Villar and Loren [Legarda] is also running and [Panfilo] Lacson has announced to run, and [Makati City] Mayor Jejomar Binay,” Rodriquez said.
The congressman, however, clarified that Estrada had already turned down the suggestion of the Partido ng Masang Pilipino (PMP) for him to run. The PMP is Estrada’s political party.
He said Estrada only wants to become a senior adviser and continue his pro-poor advocacy.
“He already announced he is not going to run, but with this kind of situation the opposition might lose, he would like the opposition to be in power…,” the congressman added.
Estrada admitted that he is not yet closing his doors on seeking the presidency in 2010.
For now, however, he said he only wants a united opposition.
“Everything is speculative. It’s open to everybody. But now, I only want a united opposition… but am not closing the door,” said Estrada.
Estrada, 70, was pardoned by President Arroyo in October after the Sandiganbayan found him guilty of plunder a month earlier.
The executive clemency capped a six-year legal battle following Estrada’s ouster from Malacañang in January 2001.
Ramos too?
Former president Fidel Ramos, meanwhile, may also decide to run again for the country’s top political post should Estrada insist on campaigning for the presidency in 2010.
A report in The Philippine Star quoted Ed Malay, Ramos’s spokesman, saying that the former president may also run again like Estrada.
“…that will be the mother of all political battles in the country,” Malay said, referring to the possibility of a presidential tiff between the two former presidents.
He said Ramos’s supporters, particularly those who helped him win under the Lakas-National Union of Christian Democrats party in the 1992 elections, want him to take another shot at the presidency. Estrada was elected in 1992 as Ramos’s vice-president.
Estrada won by a landslide during the 1998 election. He defeated Speaker Jose de Venecia Jr., who was endorsed by Ramos.
Malacañang reminds Estrada
Sergio Apostol, chief presidential legal counsel, reminded Estrada that part of the reason he was released from detention was the condition that he agreed to when he accepted Mrs. Arroyo’s grant of executive clemency — that he would no longer seek public office.
Apostol reiterated that Estrada had already promised to stay away from public office, apart from the supposed fact that it is against the law to seek another term of office — whether or not he finished his previous term.
“Oo pwede pa niya baliin ‘yong pangako na ‘yun (sa pardon) pero ground ‘yon para magsampa ng disqualification sa kanya,” Apostol said.
(Yes he can break his promise but it is a ground to file a disqualification case against him.)
For his part, Justice Secretary Raul Gonzalez said the a provision of the Constitution clearly states that Estrada can no longer seek reelection.
He said Estrada’s term was over and that this has been legally recognized. Gonzalez also said also that a successor had assumed Estrada’s post.
Gonzalez cited Section 4 of Article 7 of the Constitution says that: “The President shall not be eligible for any re-election. No person who has succeeded as President and has served as such for more than four years shall be qualified for election to the same office at any time.”
Gonzalez also said that this was also the reason that the issue of term-sharing that was being speculated upon has become moot and academic.
Estrada told: Unite opposition
Former congressman Gilbert Remulla of the Nacionalista Party said Estrada should give way to new politics and should instead focus on uniting the opposition.
“Dapat siya maging isang kingmaker at siya ang united force ng oposisyon at kailangan niyang pagbigyan ang mga bagong ideas, bagong mukha,” ani said Remulla.
(He should be a kingmaker and be the uniting force of the opposition. He should give way to new ideas, new faces.)
Former congressman Florencio Abad of the Liberal Party, meanwhile, said that their “presidential bet” Sen. Manuel “Mar” Roxas, is unlikely to give way and settle to run as vice-president.
“We the liberal party are going to wage a presidential campaign, not a vice-presidential campaign. I find it difficult to see Mar Roxas stepping down from vice president,” said Abad.

If my recollection is right while I was watching the kapuso Network’s coverage of the ERAP trial, the Network’s atty was saying that based in the history of the jucidal systems of the “WORLD”, he said and I quote: “no special created court ever… (he stressed it) “EVER”… acquited an accused”.
It can therefore be said that Pres. Erap wasn’t going to get a fair trial since in the begining; because the special court created by the sandiganbayan is bound and created to convict him.

We respect the decision of the Sandiganbayan in regard to the plunder case against former President Joseph Ejercito Estrada.
We presume the court arrived at its decision after careful evaluation of evidence presented during the trial.
The Black & White Movement, however, laments the selective application of justice - expedient and with a heavy hand for those perceived to be enemies of the GMA regime, while slow and protective toward those allied with her.
What is the difference between Jose Velarde and Jose Pidal?
Why has this government not pursued the cases against Nani Perez, Joc-Joc Bolante, Virgilio Garcillano, and more recently, Benjamin Abalos’ alleged complicity in the ZTE deal? Instead of pursuing these cases, this administration has stonewalled through gag orders such as the illegal EO 464 and questionable MO 108.
This reflects the sad state of our justice system where political patronage is the rule of the day. Those out of favor with the powers that be are prosecuted while those in the inner circle are beyond the reach of the long arm of the law. As former President “Erap” himself has put it… “weather-weather lang.”

Palace says destabilization link a ‘kiss of death’

A DAY after claiming an endorsement from President Gloria Macapagal-Arroyo would be a “breath of life” for presidential hopefuls in 2010, Malacañang said any link to destabilization is a “kiss of death”.

Presidential Management Staff (PMS) director general Cerge Remonde said the public sentiment is that anyone linked to destabilization at this time is rejecting democratic processes.
“They will be rejected by electorate come election time. Anyone who will participate or support directly or indirectly is in effect saying they do not believe in democracy because they don’t adhere to democratic processes,” he said.
He added anyone linked to destabilization “are not deserving or worthy of support of peace-loving, freedom-loving democratic-oriented people.”
He said this is why several recent destabilization attempts have been failures.
“People want those who want to take over now to wait until 2010, and not to disrupt the economy. That’s the popular sentiment,” he said.
“Every destabilization attempt is not only attack against President Arroyo and her administration but any destabilization attempt is against the entire Filipino body politic and the entire Filipino people,” he added.
He reiterated Malacañang’s challenge to presidential wannabes for 2010 to show their stuff by helping in good governance.
“I believe the best politics is good competent and efficient public service. Anyone seeking public office for 2010 should prove to Filipinos they are good and efficient public servants worthy of their support in 2010,” he said.
He said Arroyo will remain focused on the “economy and good governance.”

A six years trial which mainly is based on a testimony of a criminal 130 million thief can not be very fair. Where the acte, stealing briber get free (and promoted)while the passive bribetaker is slapped with possible life term?
And why Atong Ang was not very credible as long as he did not testify against Erap but became immeiately very credible when he testified like the prosecution wants? The same now with Doble, he was not credible when he accused GMA but very credible when he retracted and now not credible again when he turned back to his first testimony.
Six years investigation and no real proof. Where are the billions? Why Chavit and Ang are not forced to show how they delivered the millions to Erap, when it has be shown already that it is not possible to pack that much bills in the boxes and then to carry about 90 to more than 199 kilo (depending on the denomination) through the very guarded entrance to Erap? Why nobody asked Chavit why he knew the most little detail of his ledger about payments to Erap but could not even remember who are behind his other codes of payments? Why this booklet has never been professional and independent checked whether or not the writing has appropriate age, matching with the written dates? Was the investigation so unprofessional or just not interested to check it because by failing to match, Chavit instead of Erap would have become the criminal? What if Erap, as long as still President, would also have issued EO’s which prohibits any official to testify or to attend any hearing?

The law was broken when Estrada was forced to quit his presidency without due process of law, therefore, from then on, any presidency that takes over is a bastard presidency, no matter how much numbers are hyped.
I have no love for Estrada.
Personally I think he is a disgrace to the Office of the Presidency, and he disgraced Malacanang, if what I heard about the “toma-tumba-suka” sessions inside the presidential palace were true at all.
But the rule of law was not followed in his ouster.
Therefore, technically, he is still the president, and we are guilty of injustice to a duly elected president, elected without the usual violence, massive vote-buying, and cheating that marked other Philippine elections.
And by extension, technically, the court that convicted him was a kangaroo court, and GMA is a crown grabber.

A GMA News Flash Report quoted Estrada as saying that if De Castro is interested in joining the opposition he should do it immediately.
The same report said that De Castro was glad about Estrada’s offer. The Vice President said he is open to any possibilities as long as these are in keeping with his objectives and programs.
It added that De Castro wants to talk to Estrada on the matter but at a proper time.
On Saturday, the opposition said it considers De Castro as the most formidable presidential candidate of the administration, but he is still beatable.
Cagayan de Oro City Rep. Rufus Rodriguez and lawyer Adel Tamano, spokesman of the United Opposition, said De Castro would still be trounced by the opposition bet.
“Vice President De Castro is the most formidable but he is beatable by a strong opposition candidate,” Rodriguez told the weekly Kapihan sa Sulo Hotel forum in Quezon City Saturday.
Rodriguez said the opposition is bent on getting its act together so the coalition can field one presidential bet to clinch victory in 2010.
The Cagayan de Oro City lawmaker is also the spokesman of Estrada’s political party Pwersa ng Masang Pilipino (PMP).
In other developments, Manila Mayor Alfredo Lim, a political ally of Estrada, said Sunday that the former leader wants prospective opposition presidential bets to talk among themselves and eventually come up with a unified bet in time for the 2010 polls.
He said Estrada stressed this point during a party attended by his political allies Saturday night.
“Sinasabi lang niya sana ang leading five presidentiables sa opposition magusap-usap at piliin among themselves sino ba ang talagang gusto ng tao at sino ang karapat-dapat (He wants the leading five presidential bets to talk among themselves to decide who the people really want and who is the rightful opposition bet),” Lim said in an interview on dzBB radio.
He added Estrada himself reiterated he has no plans to run for president in 2010. Estrada’s reported intention to run in 2010 had sparked debates on the issue.
Estrada earlier named as probable bets Senate president Manuel Villar Jr., senators Panfilo Lacson, Loren Legarda, Francis Escudero and Manuel Roxas II, and Makati mayor Jejomar Binay.
But Lim admitted Estrada’s latest stand may not be practical as the opposition bets each believe he or she is the rightful opposition standard-bearer.

One sad thing to note though is how come there are still many Erap supporters, loyalists and fans. I can hardly believe this. It only means a lot of us are bankrupt of moral values. A man who admits to have a dozen or so mistresses or women in his life doesn’t deserve to be honored, adminired, followed, adored and much less rewarded of the highest position of the land. There is a saying that “tell me who your friends are and will tell you who you are.” So, whoever is with Erap as friends, supporters, loyalists or followers, we can more or less determine what type of these people are and how ruined are their values.

You better believe it! Erap is corrupt but not as corrupt as Gloria and her compatriots. Erap is mambababae, and who is not in the circles of these corrupt politicians? Allegations against Estrada’s plunder has never, never, never been proven without stain of dishonesty and wicked misinterpretation of the law. Chavit Singsong said he can’t prove his allegations, he who is a jueteng lord himself. Another is that Erap may not have gone far to Harvard, but he is not a liar like Gloria. He did not cheat when he was elected President. Gloria was alleged to have cheated and has been using unconstitutional executive orders to squash the investigation of herself and Garci. Erap’s friends are common folks star-struck Filipinos, but Gloria’s friends are the scums faking as economists like herself. We are proud Filipinos whose heart, like Estrada, throbs with the masses who are longing to be free of the kurakots and fake government that is now reigning in the Philippines. Gloria has nothing to offer the Philippines except her promises that are bound to be nailed tight because all her cronies are appointed in their positions based on their loyalty to her, not on their qualification to execute intelligently whatever programs she initiated. Take the VAT, still very little is flowing into the coffer of the Philippines. See how she dole out moneys that should have been spent wisely to build the economic infrastructures for the poor, instead she is doling the poor food good for the day as if the poor are hungry dogs. Her economic policies are only meant to benefit those who are already rich. She is artificially increasing the countries easy manipulated economic figures by selling the country’s infrastructure to the foreigners and privatization of government agencies. Walang matitira sa mga batang hindi pa naipapanganak while the rich who are skimming the little dollars that are coming into the country are being spent as fast as they can through their frequent traveling abroad kasama lahat maski yung mga tagapunas ng kanilang mga puwit. Geezzzz…give me a break!
