The Estrada trial
THE TRIAL of President Estrada is the first case of a former Philippine president being accused, arrested and tried for alleged crimes committed during his regime. Our society has become polarized on this issue, and the impending verdict seems like a brewing storm looming over the horizon.
As it was, the ball fell into the hands of the Sandiganbayan, where a special division was created, to conduct a speedy and impartial trial. And rightfully so, due to the uniqueness and precedence of this case.
The aftermath of EDSA II, the force which catapulted Mrs. Arroyo to power, saw a third force which aimed at reinstating Mr. Estrada. Certain politicians rode the crest of this third force but abandoned it later on. A string of events occurred culminating in the violent dispersal at the gates of Malacañang.
This was the first feather on the political survivor cap of Ms. Arroyo.
The trial of Mr. Estrada on the charges leveled against him is already a part of history. The impending verdict, in my view, is a necessary evil to put a closure to this. It is therefore the duty of both opposition and administration elements in government not to inflame the passions of supporters but to let reason prevail. On this, let history be our judge.

True, thisdrama has to end. The only question is, ending just forending or ending with truth out.
A six years trial which mainly is based on a testimony of a criminal 130 million thief can not be very fair. Where the acte, stealing briber get free (and promoted)while the passive bribetaker is slapped with possible life term?
And why Atong Ang was not very credible as long as he did not testify against Erap but became immeiately very credible when he testified like the prosecution wants? The same now with Doble, he was not credible when he accused GMA but very credible when he retracted and now not credible again when he turned back to his first testimony.
Six years investigation and no real proof. Where are the billions? Why Chavit and Ang are not forced to show how they delivered the millions to Erap, when it has be shown already that it is not possible to pack that much bills in the boxes and then to carry about 90 to more than 199 kilo (depending on the denomination) through the very guarded entrance to Erap? Why nobody asked Chavit why he knew the most little detail of his ledger about payments to Erap but could not even remember who are behind his other codes of payments? Why this booklet has never been professional and independent checked whether or not the writing has appropriate age, matching with the written dates? Was the investigation so unprofessional or just not interested to check it because by failing to match, Chavit instead of Erap would have become the criminal? What if Erap, as long as still President, would also have issued EO's which prohibits any official to testify or to attend any hearing?
Guilty or not, a fair trial has Erap not to expect, wonders excepted.

The gears of justice seem swift nowadays. We should start cracking the whip-- Abalos, First Gentleman, etc.
Maybe after her beloved presidency. Or another round of impeachments?
If Guilty
If found guilty Erap Estrada should immediately be brought to the Penitentiary but before going there should undergo the process of every person convicted. Would Erap feign illness to avoid jail? Would he play sick and claim that he has heart problem or an unknown malady?
Perhaps but I don’t think the court and the Department of Justice as well as the Bureau of Jail Management and Penology should just allow him. Otherwise this would be something of a special treatment not accorded any Juan, Pedro or Tomas who are immediately marched off to prison after being sentenced with conviction.
If found guilty Erap could file a Motion for Reconsideration within fifteen (15) days from today or file a file a direct appeal to the Supreme Court. Since the case of plunder is higher than 6 years in penalty he won’t be able to make use of probation. I also don’t think Erap would just sit by and accept pardon from President GMA- its more likely he’ll bite the hand if it was offered to him.

Is this good? I guess so. The economy being in shambles during the Erap reign was the main reason I joined the diaspora of my countrymen for alien shores. But was he worse that the Marcoses & the rest of their cronies who still hold key positions in our abused & blighted land? Or even those employed in our graft-ridden government offices. Erap is just a small drop in the huge ocean that is corruption which is destroying our country. I think for this to be an effective way of showing that corruption will not go unpunished is to not just to pat our backs & stop here. Otherwise, this would just be another hypocritical show. And as Gandhi says: "Corruption and hypocrisy ought not to be inevitable products of democracy, as they undoubtedly are today...”

I admit that I doubted that the Sandiganbayan would render a guilty verdict on the plunder case of former President Joseph “Erap” Estrada. So when the anti-graft court handed down the “guilty” verdict, it really came as a surprising relief. Now I will not discuss the merits of the case. I am not a lawyer. You can watch or listen or read the pros and cons over the media. And it can still be appealed. It is not yet final.
Let me focus on the rule of law instead. As a country, we thrive in shortcuts (whether in getting a driver’s license or in unseating the powers that be). We ousted two presidents already through “People Power.” Erap faced an impeachment court but it was cut short by a walkout. Then people massed in EDSA. The rest is… well, history. The problem was our shortcut short-circuited the legal process. In a sense, we ended up with a mob mentality, that is, we tend to force our way when things don’t go our way.
Whether we agree or disagree with it, we should respect the decision of the court because we are a nation ruled by law. Though they have the right to exhaust all legal means to appeal the case, I pray that the Erap camp will also respect that rule of law. I just hope that people who disagree with the decision would stop inciting more protests or would not provoke another uprising. We need to learn to submit to the law and go through the process no matter how unfavorable or tedious it may be. As a legal cliché goes, “The law may be hard but it is still the law.”
It is the same with the Word of God. Because God said it, that settles it, whether we believe it or not. The Bible may not go the way we think it should go, but we should go where it bids us to go.
The verdict is in. Let us move on.

That "judicial process" is just a kangaroo court...why?

The worst part is.....its not only Erap who is going down....but the whole nation, because of this "false truth".
From the very beginning (impeachment trial)...this has all been a mockery of "pure justice" and "rule of law".
Guingona's judgement over what he sees after the impeachment should be THE wake-up call to everyone....but nay....basa na mga paa ng nasa administration so lumusong na sila at naglubalob sa putikan.
At least, now i can say justice prevails in my country. If a person is convicted by the our law "Dapat pantay-pantay ang treatment para di pamarisan" kung sa Munti dapat ilagay wala dapat special treatment. Ano lang sasabihin ng ibang bansa sa atin..?
Good Riddance. There was no fair justice here. For 6 years he did pretty much as he pleased. Lived a good life while awaiting trial in his luxurious rest house. He will probably appeal the verdict and drag this trial even longer. Then dying before he serves even a second in jail. After death, he will be revered as some sort of "Robin Hood" by the ignorant masses. Probably a street in Manila will be renamed after him. I can see it now, Joseph "Erap" Estrada Avenue.

The first statement above, I agree 100%. But with the second sentence, you just immediately overthrown your first statement. Delete it or retract it, is best. Retain it, then its not rule of law you're talking about but your biased view.
Pardon those wordings, but it is what it is. You are praying for "Erap camp", why not for all? Have you forgotten, those "lawyers" on Erap's impeachment proceedings who "trashed" the law by staging a walk-out? Disrespecting the presiding Davide (who amuzingly just let it pass, and later on joined the MOB?) and most especially the Filipino people watching that happen LIVE. Oh I remember it so well.
And of course, after the DEED is done....we summarize everything by "Lets move on".

The problem with Atty. Rufus Rodriguez and Atty. Saguisag when they talked to the press they were so sure of themselves of acquital. They even crowed that if Erap Estrada is acquitted then the Arroyo government of 2001 would not have any legitimacy. So now that the Sandiganbayan ruled to convict their client would they then change course and say- the Arroyo government is legitimate?
Well my good companyeros you should read Aesop's fables- don't count your eggs till they're hatched. Now that you've mashed the two different things together- Arroyo government legitimacy and the fate of your client- then using the twisted logic- the GMA government is now legitimate.
Actually the Supreme Court has already ruled before that the GMA government is legitimate only you won't listen. You prefer the logic- if Erap is acquitted and then the GMA government is not legitimate. But things went the other way around. I expect you to say- Erap is guilty the GMA government is legitimate.
History tells us that success has a hundred fathers and failure an orphan. That is clear today with the turnout of the crowd of supporters for deposed President Erap. It was a measly turn out. The crowd of Edsa Tres is visibly absent despite the clear rainless sky.
The problem with people like Erap they will only say the court is right if it agrees with them. Now he says its a miscarriage of justice. But he played with the court, appeared there, presented evidence, etc- and now they have the nerve to say its a kangaroo court, etc- etcetera. Had they won they would have said "Oh justice prevailed- there is still justice in this doomed world" or something like that. Well the game is you win- or - you lose- you stick with it.
Maybe Erap thinks the court is unfair- he should appeal this case to the MILF---or much better the NPA. Or perhaps to a Chinese court which just shoots the accused in the head. A bullet- because the government of China is saving revenue- but let's move on.
The victory- is the victory of the people- even those who are for Erap should clap their hands. Its the People of the Philippines vs. Erap and we won. Seems Erap is alone by now in Tanay- soon a resident of Munti or Bilibid or if he wants Iwahig. Someone is suggesting building a jail in Tanay- well I could visit him I reside in Antipolo.
More to the point aside from the conviction- there's a bonus. The monies of Erap almost half-a billion are now confiscated in favor of government even the house of his mistress- the Boracay mansion is also confiscated. So that's a victory for us- whether we hate Erap or not.
This is not a game of I hate Erap- therefore I love Gloria. They can even go together- We've been clouded for a long time and our visions have dimmed. Its not a question of Gloria vs. Erap or vice versa- its the fight of the have and have nots in this country all along. Gloria will get what's coming to her- but now let us deal with Erap.
Now we can say he really is a Plunderer- a Womanizer- Drunkard and now guilty of the crime without going through libel. Problem with him is he admitted it. If he's my client- I would have to gag him and tape his mouth- before I would let him speak to the court- imagine admitting he's Jose Velarde. So going out with my friends Atty. Ignacio, Atty. Natividad and my staff in 2001 and crammng ourselves with my brother Atty. Dante isn't that bad- we ousted a despot who is now found guilty as a plunderer.
While there might be debates on what the extent the verdict means as a victory of the people, it is undeniably a victory of justice nevertheless since our judiciary has spoken its decision. Nonetheless, I am terribly bothered by the showing of our senators who seem to be bothered by the verdict on Mr. Estrada to the point of suggesting he has be given injustice. Is this what we should expect from the institution that has proclaimed itself "the last bastion of democracy"? The very irony exudes from the once-principled Senate President Villar, who was the speaker of the house that forwarded the impeachment complaint against then president Estrada to the senate. Of course, it was Senator Villar who also said that what he did then in the impeachment trial might have been a mistake. And you hear the rhetoric from the likes of Senators Escudero and Estrada [younger], expressing their implicit disbelief and mistrust on the decision of the Sandigan Bayan Special Division. This is a poor showing from our Senate, who instead of highlighting the success of the justice system and its implication on the present questions hovering the Arroyo administration, had to say that they felt sad over the conviction of a criminal: Mr. Estrada. I shake my head in disbelief. While I do agree that special treatment must be given to a former head of state, I however stress that never should such privilege be extended to a criminal. Mr. Estrada has done the country extensive, probably even irreparable, damage and he deserves the humiliation and disgust for abusing his power. Once a former dictator got away, deposed but got away. Never again should a plunderer be free, rather he should have confinement for life.

Justice Prevails!! As I heard the verdict on TV I said YESSSS...I was there during EDSA2 and I was proud to be part of it disposing a corrupt president. Let him experience what is to be a inmate at Muntinlupa (Maximum security compound) we are the only country who treats corrupt politicians with a luxury villa, nobody is exempted from serving sentence in jail after a conviction, not even a former president. Other countries have former prime ministers or presidents convicted and then jailed. Why can we do it here in the Philippines? ERAP GUILTY!!!!

The Philippines is one on the most vibrant democracies in Asia. The latest decision of the Sandiganbayan to convict Erap of plunder after six years of trial is just one reason that justice prevails in our country regardless of one’s status in politics.
Rene Saguisag, one of Estrada's attorneys, added: ''In its heart of hearts, it was a case of guilt not proven.'' I beg to disagree. I thought he is a very intelligent lawyer. The defense panel has all the chance to present their arguments in the (kangaroo?) court but they failed to do it. They presented 76 defense witnesses but they can’t prove that their client is innocent. Well done Dennis Villa-Ignacio. You are smarter than Rene Saguisag and Estelito Mendoza combined.
Well, I am not a lawyer but at the very start of the case I can foresee that Erap is guilty of plunder “beyond reasonable doubt” and that prediction proves right.
Then, who’s next? In my opinion treason/espionage is more serious offense than corruption. What about the “Hello Garci” tapes? Well, the subject here is about wiretapping and not who’s wiretapped. Wiretapping is a serious crime and of course, punishable by law. Mr. Doble (ang mistress) must be charged with wiretapping but not as a witness, (just what happened in the ongoing Senate Inquiry).

Wake up man ... just because wiretapping is illegal does not mean it absolves Garci and Gloria of their shenanigans. The incident, thanks to the palace spokesman himself, is laid out for all to hear. Justice must go BOTH ways of the political fence i.e. justice INCLUDES investigating and prosecuting those abuses made by those CURRENTLY in power. We have a LONG way to go before you can say justice will prevail in this country.

Well, true that complete justice is still to be achieved, we should never discount the piece of justice upheld and won in the Erap Conviction. While it is still a long way to convicting all corrupt officials, the conviction of Erap is still a milestone. Instead of looking at this moment with a sigh of doubt because of the seemingly insurmountable task before us, let us look at this point of our history with a sigh of relief that hope is still alive. Indeed, let us celebrate, nonetheless, strive further.

This is not a proper place for a debate. I respect your opinion. What I have written earlier is just a personal opinion and not intended to create a stir. We have "kangaroo" courts isn't it? May the best lawyer wins.
In the Philippines any person is considered "innocent unless proven otherwise", right? Now that Erap is proven "guilty beyond reasonable doubt", do we have to go to the steets like mobs in order to prove the world that he is innocent and the "kangaroo" court is bias in their decisions? Just asking. Did you know that in Greece any person who commited a crime is considered "guilty unless proven otherwise"?

In the news, Estelito Mendoza is blaming some Jane and John Does for what happened to Erap. What a crap! Were they gagged during the presentation of their arguments. Erap was the President of the Philippines during the time the crime was commited. Another thing is aside from Clarissa Ocampo, the star witness, they have Chavit Singson. In criminal law, the best witness to thump down the defense is somebody who is a friend, a relative or any other person close to the accused. In this regard, the prosecution has.. in the person of Mr. Chavit Singson who was Erap's drinking and gambling buddy.
Erap is convicted on jueteng kickbacks and belle shares.

Now it is out, Erap is sentenced for plunder.
Plunder? The cases that are the basis of the conviction do not involve any PUBLIC money, which is what only makes a case 'plunder". The only plundered money has been Chavit's frauded tabac tax, but Chavit is free and Erap acquitted on this proven false accusation. And the other basis case, the BW kickback, did not go to Erap, at least there is no proof. And the alleged millions to the Erap fund for Muslim youth, his lawyer was acquitted about and if still the money went to the registered fund, it was out of Erap's control. Lastly the billions at the Velarde account? He is acquitted of being Velarde and it is proven by bank vice-presidents that the account was opened, maintained and owned by Dichaves.
So, what is then the plunder money from public sources? What would remain in a fair trial, if it woukd have been proven, would be graft or corruptin, but never plunder.
Jueteng money? It has been witnessed that the money went to jinggoy but Jinggou is qcquitted about this, so how can his father be sentenced for plunder for the same case? How culd money have personally delivered to him at Malacanang when it is proven that at the witnessed time he has not been there?
A victory of law and democracy? What a shame. All it is, is not more than a victory of opportunities, because otherwise GMA and the inventors of EDSA II could be charged of plotting a coup, admitted by GMA, and also of destabilisation, sentence life term.....

No law has been upheld.
The GMA administration is not a legal government.
The law was broken when Estrada was forced to quit his presidency without due process of law, therefore, from then on, any presidency that takes over is a bastard presidency, no matter how much numbers are hyped.
I have no love for Estrada.
Personally I think he is a disgrace to the Office of the Presidency, and he disgraced Malacanang, if what I heard about the "toma-tumba-suka" sessions inside the presidential palace were true at all.
But the rule of law was not followed in his ouster.
Therefore, technically, he is still the president, and we are guilty of injustice to a duly elected president, elected without the usual violence, massive vote-buying, and cheating that marked other Philippine elections.
And by extension, technically, the court that convicted him was a kangaroo court, and GMA is a crown grabber.

Then do not bring up the issue of Garci's supposed "innocence" since many beg to disagree. The point that the corruption and abuses of the past and present are not resolved is the reason that we cannot "move on".

Ang alam nila nasa pwesto sila at may power na pwedeng gamitin sa mga mahihina para sa kanilang kapakanan sinisiguro ko sa out of 100%, 95% ng mga nasa pwesto President hanggang sa lokal alam natin nagnanakaw sila at alam lalo ng mga media pero bakit walang nangyayari dahil sa may butas (batas pala) daw na di ka puwedeng kasuhan hanggat walang mabigat na katibayan what a fool we are!! Kaya si Erap ang ginawang halimbawa pero yung Gambling Lord na kinukuhanan daw ng pera ayon kay Singson malaya pa rin. We presume the court arrived at its decision after careful evaluation of evidence presented during the trial.
The Black & White Movement, however, laments the selective application of justice - expedient and with a heavy hand for those perceived to be enemies of the GMA regime, while slow and protective toward those allied with her.
What is the difference between Jose Velarde and Jose Pidal?
Why has this government not pursued the cases against Nani Perez, Joc-Joc Bolante, Virgilio Garcillano, and more recently, Benjamin Abalos' alleged complicity in the ZTE deal? Instead of pursuing these cases, this administration has stonewalled through gag orders such as the illegal EO 464 and questionable MO 108.
This reflects the sad state of our justice system where political patronage is the rule of the day. Those out of favor with the powers that be are prosecuted while those in the inner circle are beyond the reach of the long arm of the law. As former President "Erap" himself has put it... "weather-weather lang."
We can only hope that when the political winds change direction, those who are currently in the circle of power, who are allegedly involved in crimes more sinister and heinous than Erap's plunder, will have their day in court.

what are these people talking about the rule law having prevailed? edsa 2 was illegal except to davide and gloria. she forced that illegality down our throats and as**s numerous times and even created e.o.s to cover everything up! the verdict is a political one, not on the merits of the case. how can the sandoganbayan contradict the decision of its corrupt higher court? by letting estrada off would be admission that everything they have toiled for in the past 6 years is nothing! the economy of the country rides the trend of its neighbors and the usa. there are more people around arroyo who deserve the verdict a lot than estrada does. justice and law did not prevail, gloria did! and how!
