AFTER spending hundreds of millions for the Joseph Estrada case and after he has been proven guilty of plunder, he is going to walk a free man again soon.
As a political scientist and a student of law, I say our justice system is the worst in the world if he is to become a free man despite the seriousness of the crimes committed by that old man.
Our sentiments for him do not matter. Yes, he deserves pity somehow. However, he does not deserve to be a free man at all.
Justice shall be served. Justice shall prevail.

Plunder law RA 7080 states that penalty for conviction is reclusion perpetua.
Under ADMINISTRATIVE CIRCULAR NO. 6-A-92 dated June 21, 1993 by then Chief Justice Narvasa clarified that
“‘The Code (Revised Penal Code) does not prescribe the penalty of life imprisonment for any of the felonies therein defined, that penalty being invariably imposed for serious offenses penalized not by the Revised Penal Code but by special law. Reclusion perpetua entails imprisonment for at least thirty [30] years after which the convict becomes eligible for pardon. It also carries with it accessory penalties, namely: perpetual special disqualification, etc.
One of the powers of the president is to grant reprieves, commutations, and PARDONs, and remit fines and forfeitures, after conviction by final judgment, except when the President is under impeachment.
Did PGMA not violate the provision of reclusion perpetua that pardon can be imposed on the convicted after 30 years only in prison? Please clarify.

Gloria Arroyo made a mockery of Philippine justice system. She pardoned Estrada so there will be a precedent when she is in the same situation. She will spend time in prison with Estrada as her cellmate when history renders its decision.
