Is punishment for confessed Eagle killer justified?

| 28 Comments | No TrackBacks
I agree that the confessed Eagle killer should be punished but I feel that he hunted out of extreme necessity and that is not a mitigating circumstance. We must be compassionate and allow him to do time for the propagation of that eagle species. At the same time, he will be able to be productive to feed his family. His acceptance of the guilt and not knowing that the bird is endangered bothers his conscience, a part of punishment. Is his crime more serious than the ones committed by some politicians stealing millions? Arnold Salvosa, Tujunga, California (via e-mail)

I don't know what punishment he got, you did not mention.
But he should not be punished.
He lives in the jungle, so jungle rules, meaning, he lives like an animal so he must hunt like an animal to survive.

There is no distinction if a predator hunts for a prey. Just like an animal, kill or be killed. Animal does not know any rules, does not know if one is endangered, or does not know if Atienza is the DENR secretary that prohibits the killing.
What I mean to say is... the man who killed the endangered specie is also an endangered man specie and should be afforded protection.

In Africa, natives can kill lions if they kill their cows.
The law is kill or be killed.

In the program for the conservation of our natural resources as well as in saving our rare animal species from extinction, the concerned government agencies should have done an effective information dissemination to enable the entire population appreciate the government program.

The action of the farmer in killing the eagle for food is simply due to having a hungry stomach as well as being ignorant about the law for preventing the extinction of that rare bird specie. The farmer's penalty is quite harsh, instead of long jail term should be few months just to send message to the nation to observe the law concerning this matter. On the other hand, the relevant government agencies like DENR and Bureau of Animal Industry should have done their work better in this regard to avoid this kind of mistake.

it serves as a notice to everyone, he should be jailed if not get maximum sentence required otherwise there will be others like him who will do the very same thing. ignorance of the law is not an excuse.

its impossible to agree on the statement that he didn't know that the eagle was endangered. there are many groups out there educating the people on how to help the endangered species survive. when he shot that eagle, all the efforts of the people who helped in one way or another to safeguard the eagle was destroyed. we can't point out that he should be spared from the law so that he could feed his family. we cannot also point out that there are politicians stealing millions and compare it with this case, its very different. he should serve time and that he should serve it completely so that it will be a lesson to him. his friends whom he had shared the eagle tinola should also serve time but on a lesser degree just to teach them that what they did knowingly or unknowingly is wrong.

The way I see it, this is genuine ignorance on the part of the one who shot the eagle. Punish him indeed, but it may be better to give him something more constructive to do, such as community service.

Fining a man with almost nothing with one million pesos is tantamount to killing him in this situation. In doing so, the Gov't will probably end up doing a far bigger act of crime against his family than he did to the Eagle.

For the DENR, they will want to look into a proper awareness/indoctrination program for the locals to ensure this sort of incident will not happen again. At least not as frequently.

Poachers, on the other hand...

yes, of course it is justified. i say he should even have a heavier sentence. the killing of an endangered species is not to be tolerated.

yes, i agree that there are politicians stealing millions but they are not killing anyone or any endangered species for that matter. at most, some people just suffer from hunger but they still have a choice.. whether to work for food or not.

besides, everyone steals even in developed countries, not only in the philippines. give those politicians a break

Poor guy he may not know if the eagle is a rare bird to him its food, Why punish him. Why not punish the corrupt government official's who's robbing the government coffer.

This is what happen when we have a corrupt justice system. Only the poor people going to jail while the richs and powerful continue robbing the taxespayer's money. How can you justify that.

We cannot bring back the eagle's life by killing the family of its killer. Its only unfortunate that the farmer hunts for food because he can't afford to buy.

I doubt that the family of the farmer will stop killing eagles. It will be a sweet revenge for jailing their father and feed their hungry stomach only this time no one will go to the confession room.

Give them chance to repay by helping in the community and in Eagles preservation.

Yes politician stealing millions does not kill anyone it only makes us suffer.

He should not be punished.

The following people should be punished.
1.The DENR secretary for giving permits to to log on the birds' habitat.
2.The politician/loggers for cutting trees like a barber cutting long hair.

The bird' area of prey and habitat have been shortened by these people. The eagle has nothing to eat that's why they hunt the monkey for their meal. Gone are the squirrels, the mouse deer, and other birds which are favorite dish of this eagle because of bald mountain.
Now, we blame this man who accidentally killed the eagle which you call endangered. Everything is endangered. No more is safe in this country.
Please spare the man from punishment. Anyway, the eagle will die if let go in the wild for there is nothing more to eat.

If filipinos can eat dog, the man's best friend why not a wild bird.
Enough of hypocrisy, you bird lovers.

The eagle is gone. Think of the family, the farmer will leave behind should he be incarcerated. One million pesos penalty? Let not grandstanding over-rule compassion.

Nakakaawa sya pero, he must be responsible and face the consequence of his actions. Ignorance of the LAW excuses NOONE!!

Sana binenta na lang n'ya at least, nabuhay pa 'yung eagle...

We have always fought for equality of the law since time immemorial, and equality means that the law should be applied to everyone regardless of stature in life. We cannot selectively apply equality only when an indigent is a victim. We also need to apply it when the indigent is the one who committed the act.

Though I admire filipinos love for Philippine eagle, it is also time to go on for we cannot bring back the life of that bird.
California's condor is an engdangered specie of bird. But when nurtured and let go in the wild, they did not survive and died by the numbers.
Just like the Philippine eagle, when let go in the wild, he will not survive for the mountain he used to fly around is not the same anymore.
Gone also are the bird's prey, nothing to hunt and so this Agila became the hunted.
Even Manny Pacquiao's advocate for the beloved eagle did not help.
But this is to remind our angry agila lovers, that we have also plenty of birds that need protection.
Like the pipit, the maya, the pulakpulak, the layanglayang, the kuwago, the kalaw, the kilyawan, the tagak, tikling isama na rin ang pugo, uwak at lawin.
These birds are nowhere to find now. When I was young I used my tirador to kill the bird, unluckily I was not a sharpshooter and had not killed one or else I will not defend these birds for I am also in pari delicto.

Anyway, let the man be spared from punishment for killing that bird for the bird also will do the same... for he will say
"Birds of the same feather flock together"

This is the Philippines and this is reality, only the poor goes to jail while the rich can get away with any crime, including those politicians who stole millions of money from us(taxpayers).
I am not a bird lover of some sort but I think the law should be applied here, just like other laws we have in our country. Also, this is the first case that should become a precedent, otherwise, future offenders should not be punished at all. But I also believed of a lighter punishment because of the acknowledgement of guilt.

1. You can't assume that everybody knows that a Philippine Eagle looks like.

2. Have you ever tried hunting? More often than not, the only thing you'll ever see of your target is its silhouette, and even then you're not sure if you hit it unless it falls, or runs.

3. Eating nothing vegetables will only carry you so far. If he had to go out hunting, it's implied he was already that desperate. That, and it's cheaper than buying a chicken.

Violating the laws of the land has corresponding penalties or punishments. it was already proven that Mr. Balaon had killed an endangered eagle, I concur that he should be punish for that viloating of our law but not to the extent that he will be punished for a very long period of time. Accepting his wrong acts may somewhat be an element that could lessen his punishment. A just punishment will do for him, I think 6-12 years is not just for him. It will hamper his self-improvement.
The corrupt officials in our government should be the one to be haunted and be punished for high penalties.

Ibon mang may layang lumipad, hulihin mo at umiiyak, bayan pa kayang sakdal liyag ang di nagnasang makaalpas.

Death to the bird eater and Gloria should resign because people are now eating birds instead of chicken.

This is, should we say an overkill reaction… we love nature and its species…

Putting a man to jail by eating eagle or any other birds or any endangered species to feed his family is overkill… is the lives of this eagle is more important than the lives of human being?... is this justifiable? Are the groups or the person who initiated this action has conscience? Did he/she or they able to think deeply the reason why this man killed and eat this eagle?...

But how about if the man who killed and eat this eagle is a government official, or a mayor, a governor or a congressman? who is a trigger happy and is having fun shooting and eating this kind of species, which he believes is an aphrodisiac?...

Did the group or the person who handcuffed and jailed this poor man will do the same thing?... I don’t think so… that’s the reality… you are all correct… justice in this country are rarely for the poor… it’s only applied most of the time to the rich and famous… that’s the reality… whether you accept it or not…

the bird killer just went on his way to avenge his relatives the monkeys...i was told that the eagle that he killed was a monkey -eating eagle...

but kidding aside, this is a serious problem, these birds are considered endangered, the killer deserved to be punished, yes, he deserved even to be humiliated, ignorance is not an excused, people shoot these poor creatures out of fun, and that was just a lame excuse , so to speak that he killed the bird to eat it...lame excuse, lame killer...

there is no excuse for killing a natural wonder whose lives are hanging on the balance of survival. if you see the killer, he looked liked he had much alcohol in his system to cloud his brain, but then again, he is an idiot....

but if he really did kill the bird for food, hey he should start arming his rifle and kill the source of hunger----here's a clue, she is a cheater and also a squater in malacanang...

kill the source, solve the problem....but then again , he will still end up in jail...so the solution is go fishing..

chow!

the man killed the eagle for food.. damn! i blame the government oppositions. they are making our country looks bad that's why no foreign investors are coming in. no investor no employment, no employment no food. this man should shoot & eat the oppositions one by one until they become extinct..... i wonder what will be their reaction on this.

siguro si "Manong J" ay politiko, may kapatid, kamag-anak, kapuso, kapamilya na pulitika, kc sya lang demedepensa sa politiko na mentioned here are corrupt!

Aminin 'Manong J'?!

Haha!

In the program for the conservation of our natural resources as well as in saving our rare animal species from extinction, the concerned government agencies should have done an effective information dissemination to enable the entire population appreciate the government program.

I think it depends very much by the facts. It's not normal to punish in this way a people but sometimes some examples are very indicate for others. Best regards, fonduri structurale
