IT is lamentable (to borrow the word of Senator Pangilinan) that Mon Tulfo would call Ermita and Atienza “decent men,” while branding Jun Lozada’s claims “exaggerated.”
Now we see why the country is in a lamentable state. We glorify those people who never manifested “decency” when the NBN-ZTE scandal was a hot item, while the person who risked everything is being crucified.
At least I’m basing what I’ve written here from their previous actions and not based on their personality. Let me remind Mon Tulfo that even family and friends of criminals say that those criminals are “mabait” and not capable of committing crimes.

JUN LOZADA’S CLAIMS EXAGGERATED?
I think Lozada’s claims tried to mislead the Court more than they are exaggerated. The Court’s decision is based on facts surrounding Lozada’s prearranged Hongkong trip which he himself initiated primarily to evade the senate investigation, and his return trip which again, he requested his boss DENR chief Jose Atienza to arrange for him. From a simple case of helping an uncooperative witness elude a senate investigation everything was blown out of proportion by the witness himself when he tried to twist things around after efforts were done for him, all for the sake of saving himself.
The problem began when Atienza did not bother advising Lozada of the identity of his security detail that will meet him at the airport. Blame Atienza for failing to give proper instructions to the security men who immediately panicked at the sudden appearance of media at the airport and upon warning alerts of possible kidnapping of Lozada they heard over the radio. A series of mistakes followed which turned the event into a comedy of errors. The event became comical when Lozada’s hysterical family was heard on radio frantically looking for him which must have frightened Lozada’s security and who must have looked silly running around the entire length of the South Expressway like headless chicken totally at a loss on what to do next which explains the indecisiveness of their action until they were told much later to bring Lozada to La Salle where his family was waiting. All throughout the episode there was no threat of danger to Lozada’s life.
Prodded by the religious to tell what he knew about the NBN-ZTE deal Lozada decided to come clean but he gave a different spin with regard to the reception at the airport to make it appear he was kidnapped. That he was instructed on what to say is pretty obvious. Even in the end Lozada tried to mislead the Court.
My view on Lozada’s acclamation as whistle-blowing hero by some and resented by many is because he was part of the system that helped make this government corrupt which by his own admission his task was to moderate the greed of the corrupt. Just like whistleblower Joey de Venecia III, who also blew the whistle when he failed to get the NBN business after his father’s strong political influence failed too.
They rejoice because they have made people look up to them as new-found heroes. But not in the eyes of countless decent Filipinos.

is a passionist appeal to the CA magistrates to reconsider points surrounding Lozada’s case which the writer saw differently. It cannot be said he is correct and the CA is wrong and vice versa. There will always be divergence of opinion as events are seen based on the individual’s perspective. The more people give their opinions the more the divergence of opinions become. Seldom will there be unanimity of opinion.
Lozada is free to elevate his case to the Supreme Court and let the highest court have the last word on it. What is important is to accept the final ruling wholeheartedly and not make claims of political bias if the decision does not agree with expectation.

In the T.V. interview by Ms. Corana Sanchez with Jun Lozada and his lawyer, I just couldn’t forget what he said about our court.
“A good government is blessed with an unbiaz court, while a corrupt government is cursed with a partial court.”
His lawyer beside him even went farther when he said that since Malacanang has a direct hand in appointing Judges in C.A. and the Supreme Court, there is a slim hope that these courts will dispense a fair, impartial, and apolitical decision.

I don’t understand why quality assurance and quality control are basically absent when it comes to production of Chinese goods. Chocolates, canned goods, chlothes, toys, and now milk products are contaminated with poisonous chemicals like formalin, melamine etc. These products are deliberately produced with these poisonuos chemicals for worldwide public consumption. The Chinese Manufacturers had been noted for this fiasco and it seems no corrective measures are being undertaken to control this disaster.
Is profit to prevail than the safety of the consuming public? Government should take drastic action to regulate the import of Chinese products and insure contaminated products will not reach the consumers.

I am not sure if the Supreme Court decision in the subject Lozada petition ever said the claims of Lozada were exaggerated. It is probable that the decision said there was no evidence to support Lozada’s petition and he is not a credible witness.
Lawyers and non-lawyers indulge in quarter-backing after the Supreme Court has appreciated the facts and it happens to support the government position. That is not lamentable. The facts are, as found by the CA and the Supreme Court, and not as perceived by quarter-backers. It is okay to criticize the decision, but it would have been helpful if the critics offered to be witnesses for Lozada and/or as amicus curiae when the facts and issues are being argued in the courts. After determining the facts, resolving the issues and applying the existing law, the Supreme Court decided against Lozada. The decision should be respected because, isn’t it that there is only one Supreme Court, and it is the members thereof, and not quarterbackers. who have the power, under our constitution, to interpret the law pertinent to the facts, as found, in the Lozada episode?

Originally, Lozada sought refuge in Hong Kong because he didn’t want to testify before the Senate. Pending his return to the country, it was Lozada that called up Lito Atienza. When Lito Atienza offered security/protective assistance, Lozada did not refuse the offer and, maybe, even welcomed the offer.
Upon his return, Lozada submitted himself to the protective custody arranged by Atienza. He did not encounter any kind of threat on his life and as far as his security is concerned, he was never more secure in his whole life. Lozada had to sacrifice a certain degree of freedom or liberty because he was under protective custody; even Presidents have to follow the advice and instructions of their security group. Therefore, clearly, the right to life, liberty or security of Lozada was never threatened nor violated because of his voluntary submission to protective custody.
To twist the facts around and make the whole event appeared as a kidnapping case is simply absurd. On top of that, for Lozada to apply for a writ of amparo we are witnessing a serious abuse of the writ. The question here is how can the Court distinguish between real and fake kidnapping? It is wrong to accuse the Court of negating the lofty aims of the Supreme Court every time it denies a petition for the writ.

Lamentable? Yes, but not in a way this one, Mr Robert Garcia would like it to appear. I agree with him that “Ermita” should have shown decency in his handling of the NBN-ZTE scandal which is to be expected from a high ranking government official like him. As for “Atienza”, he had presented his case very well in media and in the CA case which Jun Lozada had filed. You can always go back and read the decision in which the CA justices found Mr. Atienza’s statements more credible than Mr. Lozada’s testimony. People can always disagree with a court’s decision and has a recourse of filing an appeal. But to assail it without backing it up with a sound legal argument to me is downright ridiculous. The CA justices caught Mr. Lozada lying no more no less and to suggest he is being “crucified” for telling “his version of truth” is an exaggeration. He is being “crucified” to borrow Mr. Garcia’s words, not for risking everything but for being caught lying with his pants.

If he was kidnapped, why did Lozada still have the freedom to use his phone and tell the whole Philippines that he was kidnapped and his whereabouts. A kidnap victim or potential salvage victim will just disappear without a trace and not give a blow by blow account of where his companions have driven him. Don’t you still get it? On a national level, most of the crimes taking place are mainly due to poverty and prolifiration of illicit drugs, most common of which is “Shabu”. Almost all citizens rich and poor have access to this drug that is creating devastating effect to the whole nation.

In my opinion, in response to Speaker Nograles solicitation of comment on decriminalizing the law on libel, there is definite advantage in maintaining the said law. All that is needed is simple amendment thereto by adding two more elements of the law. One is to require the writer to include in their write-up their specific source or sources to guard against imagined story and the other to give the person subject of their criticism his side of the story. Decriminalization of the law on libel will only push honest journalist to the sidelines and unwittingly encourage corrupt mediamen to impute false wrongdoings for a price or some other consideration.

By insisting that he was kidnapped, Lozada lost whatever little respect he’s got left and he’d be most stupid if he still believes that the public swallowed his story.
As in the case of Lozada, it is wrong to accuse the Court of negating the lofty aims of the Supreme Court every time it denies a petition for the writ.

GMA is a thief, I can smell one because I am also a thief. Jun Lozada is one of my mentor. I hate when my friends are getting caught. Especially if they forgot to remit my shares of the loot. But the greatest thief of all is GMA, I hope she is removed from office, her share of the bite is too much that I am left with crumbs. Im not greedy just being practical.
